Sale Date NIGHTMARE!!! Need Advice

Okay, my lovely saga has been going on for 14 + months with Countrywide. The latest, Sale Date is 7/2/09. We are working with NACA. Received an email from NACA last Tuesday saying they had emailed/phoned our lender asking for sale date to be postponed. Called BOA(CW) who up until this time still said they had received nothing from NACA. As of Thursday 6/25 they show us in a workout process and said that no sale date was showing and foreclosure/collections would cease until a decision was made. I called ReconTrust (trustee lawyer for the sale) and they still show the sale as happening on 7/2/09. Call BOA on Friday 6/26 and now they won't talk to me because I'm flagged as NACA (Imagine THAT!). I explained that according to the trustee the sale was still scheduled, well I'll have to talk to NACA about that.... What do I do??? ReconTrust gave me the name of the BOA foreclosure technician, Haylee Clancy 800-669-6650 x 4592, but I can't seem to even get to a place to enter an extension. Do I start packing? Here we thought we were actually getting somewhere and now we're going to lose our home over a communication issue.... seems par for the course.

I think I would call NACA again and also keep calling BofA until you get someone there who can help you. Email Barbara DeSoer at the office of the president. Barbara.J.DeSoer@bankofamerica.com

There has been some action when folks have emailed her. Tell her the situation and see if they won't help.

Thanks Sarge! I did email Barbara last night... I just got off the phone with BOA and spoke with someone who actually seemed to care..(I'm not fooled, but hopeful!) She emailed my foreclosure technician and said that she would call me back tomorrow. I must say, it's so hard, but if I can manage to keep my voice even and not let the stress show through, I seem to get much farther with them. I kept saying, I'm not being rude I'm just having a minor panic attack! She did tell me that Haylee sent an email to NACA on 6/23 telling them my sale date was postponed until 8/1, funny when I talked to them on 6/25 they didn't mention it. Even funnier was she started by telling me that the home couldn't be sold because it wasn't in their system with a sale date. Oh okay... ReconTrust told me that it would be sold! Deep breaths....

sandbchristy, have you let NACA know about your sale date? If not you need to. They will need the notice you got from ReconTrust and you should be able to submit a foreclosure problem on the NACA website. I didn't see anywhere that you let NACA know you have a sale date. Just wanted to check and see if you have. Also, what date did NACA submit to BOA/CW for you?

Hi Sherman. NACA does know about my sale date. They actually sent an email or phoned BOA on 6/23 requesting the postponement.... My file was submitted on 5/8 and we already had the sale date at that time. I tried for so long to work with CW on my own, I thank God for this site and for NACA! I'm not getting responses from NACA at this time, I have emailed and left phone messages, and my wonderful counselor who was helping me in the beginning hasn't gotten back with me, but I know that there are so many people in my situation so I understand that they are swamped.

As an update, I did receive a call from BOA a couple of hours ago in response to my email to Barbara. Cynthia is going to find out what the issue is and call me back...so my fingers are crossed!!

Call BofA's Foreclosure Department and ask to speak with "Ronya". She is the one who helped me to get my sale date stopped.

I still haven't heard anything back... I've tried asking to speak to specific people in the foreclosure dept and it doesn't work for me. I have the extension of my Foreclosure Tech... does anyone know how to get to where you can input an extension. When I call I only get the acct number input. I feel like I'm beating my head against a brick wall! I called recontrust again today and they still have us down to auction on Thursday...they will NOT call BOA to verify.. So frustrating. No word from NACA after 2 emails and phone message left for them over the weekend.

Try calling the Foreclosure Department and speak to whoever answers...tell them you are in negotiations for a loan mod and you were told your sale date would be stopped but hasn't yet. Ask them what needs to be done to get it stopped.

I was in the same situation you are in about two weeks ago. I just kept calling them til I found someone who would help me. Let us know what they say...

I am praying for you and immediate resolution of the sale date!!!!! My date is set for Aug 3 so your info is important to me. I would keep calling BOA office of Pres until someting gets done,

Just to clarify... the main issue here is that BOA shows my sale date as being postponed as of 5/23 which is the same day NACA requested that they do so. However, they have not notified Recontrust of this fact and since they are the trustee lawyers the sale will happen if they don't receive notice.

Yes HOPE! It will be postponed but only because you have been diligent...just think of those who cannot stay on top of these isuues with this mod and who do not have the support of this site!

Woohoo! Success, small one but I'll take it where I can! Just received a call from Recontrust verifying that indeed my sale date has been postponed, they don't have the new date yet, but we have bought some time. Everyone, I encourage you to email Barbara at BOA. I was dealing with Cynthia in the office of the chair and she stayed on it until it was resolved. Thank goodness!

Yes! Also thought I would share something that is funny in a way that only those of us on this forum can appreciate. When Cynthia from BOA called me back to followup and make sure everything was settled with Recontrust, she said regarding Recontrust, "I can't imagine a company that tells you something different everytime you call." I nearly took my tongue off trying to control the near hysterical laughter. When you think about it, it makes you wonder, are the higher ups at BOA completely oblivious to the incompetence of the people they force their borrowers to deal with on a daily basis? Anyway, Cynthia was wonderful and sweet... just had to share!

I am happy that your sale date was postponed. That is what I am trying to have BoA accomplish for me. I just received certified docs from the attorneys handling my foreclosure (2 copies for myself and 2 for my husband) NACA wants me to fax all pages to them, but was sure to caution me about having a PLAN B. Stated that NACA cannot guarantee the postponment of sale or the mod approval. My confidence level is in the negative numbers now. I emailed the pres office and copied my states attorney general. Hope I get some response before the holiday.

Does anyone know if you sign forebearance papers does that automatically postpone your sale dat. NACA just told me that Fannie gave me a forebearance plan for 3 mos.

Under the Title Auction/Sale Posting signs Moe wrote back that the forebearance does stop the sale date. Yeah!!!!!!!!!!!!!!!!!!!

Hey Everyone.. Just a quick update. Found out the day after original sale date that the new sale date was 7/28. I had heard nothing from Naca so I called yesterday and left a message and emailed for an update. My only response was an email saying that my sale date was postponed to 7/28. So today, I forced my self to call the Advocacy dept. at BofA. I spoke with Marianne who was very nice. I explained that I was aware that she was not supposed to give me information but that I had been told by BofA that foreclosures were put on hold during the modification process. She told me that we don't have a sale date! She went on to tell me that Leanna Meyer was working on my account and she couldn't make guarantees but there was a note put on today that projected if modification was approved papers would go out at the end of this week or next.

I post this for one major reason. I was so discouraged because I haven't been getting any sort of response or information from NACA for over a month now. But this shows that someone at NACA is working my file, it just seems that I don't have access to that person. I'm okay with that! It also shows that if you get the right person one the phone at BofA you can get information. It's all about communication I guess. If you get someone who won't help you, hang up and call back. We all know you never get the same person twice, right?? Good luck to all.
