Need Help Asap!!

Hi Everyone,

I just received a Notice of Trustee's sale from Recontrust for June 17, 2009. I am 9 months behind in payments and I am trying to keep the house. 30 year fixed at 7% payment is $3313 I put 20 percent down and an extra 50K in remodeling on top of purchase price. House was purchased for $630,000 and is currently worth $358,000. The reason I fell behind is I had a judgement against me in which I didn't received any income for 4 months. I tried numerous times trying to work with Countrywide but everytime they said I didn't qualify for anything.
What are your guys suggestions on what I should do? I really want to keep the house at all costs and have recently sold some assets and have about half the amount I owe. I have some other assets for sale right now and if they are sold I would be able to have the full amount.
Is there anyway for me to get my sale date postponed to buy some more time to come up with the remaining amount I owe.
Do I need to file any paperwork such as an Intent to cure?
I've been reading about Naca is it too late for them too help me?
Any information would be deeply appreciated as I have 5 young children and I am getting worried if we will have a place to live or not.

Thank You,

Marty

Hello . . .

Just read your post . . . . you should enlist the help on NACA. I was also 9 months behind in my mortgage pymts. NACA worked with my provider and came up with a solution that was tailored to my current financial situation.
NACA will be able to postpone your sale

Jfulmore,

I appreciate the response back. I will set up an account with Naca and start filling out the online paperwork. I should be able to finish it up today and hopefully I can set up a quick appt. With 2 weeks away do you think I still have time left for this option?

Thank again,

Marty

Re: Need Help Asap!!

1. Hang in there! you are not alone in this!
2. Fill out the NACA submission today and send it. Use the NACA provided cover sheet.
3. Call NACA first thing Monday morning and get a phone appointment for as soon as you can.
4. Fill out the the section on the NACA site for those who have a sale date.
You should hav e time to stop the sale, but NACA will help you.

Keep us posted.

Hi Marty

Yes going with NACA immediatly is very important in your situation. When someone is assigned to your case you should follow up with them every few days until your sale date is confirmed POSTPONED.. Stay strong and I wish you the best of luck.

Re: Need Help Asap!!

Well I did everything you guys suggested and my file is completed with Naca. I also filled out the portion for those with a sale date. I talked to my counselor today as I have a dedicated one to my case and asked her about my sales date getting postponed. It hasn't been postponed yet and she said to check back. My sale date is is approximately one week from today and I'm getting a little nervous. Should I be doing anything else such as sending letters or emails to anyone at Countrywide or BofA. Based on the information I read you don"t know if the sales date has been postponed until a week before or even a day before. I'm a little apprehensive that its not going to be postponed and I'm willing to file Chapter 7 or 13 to postpone it if Naca can't. How long should I wait and is there a cutoff time for me before I lose the house?

Thx everyone.
