CW has outdone themselves this time...

I used to frequent these forums months ago but after our modification and the birth of our new baby I completely forgot my old username and haven't been around much.

Last Feb 2008 I sent a hardship and modification ltr to the President of Countrywide. I received a phone call within hours letting me know that someone would be on the case to help us do a workout since we received the run around for months. In April 2008 I think? we got our paperwork, signed off, sent the packet in and were done with these fools or so we thought.

Fast forward to April 2009 we received our lovely welcome letter from BOA informing us that we would need to send payments to them, yadda, yadda, yada. When we received our May statement I noticed that under our monthly payment due there was a past due balance of $11,798 and some cents. Immediately I called these fools wanting to know WTF was going on. Of course I got the run around, systems are merging, we don't have your complete file, excuses, excuses.

So I call BOA again and I'm told they have no record of my loan or account. I remind them that I sent them a payment in April so they should know who in the heck I am, etc. They say nope, call CW. So the circus begins...

I call the bafoons at CW and these people honestly had the nerve to tell me that my loan modification done in 2008 was cancelled and that we owed 8 payments that were put on the back end of our loan per the modification agreement. Of course I flip out and say wrong, I don't think so, this was a legal binding agreement, etc., etc. They blow me off and tell me to come up with the 8 payments or they will accelerate the loan. So knowing how these morons work, I write my letter of all letters and end up sending it to the White House, BOA president and president of home servicing, Michigan Attorney General, Michigan Governor, all Senators of Michigan, House Reps of my district, HUD, ACORN, Michigan Housing Authority and a few others. I told my story in length along with my diatribe on CW and how unethical and morally bankrupt this entire operation is, why is this allowed, it's not legal, etc., etc. I also said I was contacting every news agency I could to inform them of my story because after three years of these fools I really don't care anymore how I come across on camera. Within 2 hours of sending my email, someone in the Presidents office of BOA contacted me leaving a message that they would like to discuss this matter in person and to please call immediately, etc. Of course I was in a graduation ceremony and couldn't take the call but I just had to share this info here. I knew some of you long timers would get a kick out of rattling the chain again of CW. It's terrible that you have to cc the friggin White House and everyone else and their mother before you get action on this crap that shouldn't have happened in the first place.

I can't wait to see what on earth these idiots could possibly come up with tomorrow. Seriously this crap is so insane it's almost laughable. At this point with all the drama of CW/BOA and their shenanigans we are meeting with a lawyer later this week to go over our options. We're done with these fools and I swear to GOD I will go down with a fight because I can't believe they can renege on a modification from a year ago. WTF. The emotional stress alone is enough to drive a person batty. I'm tired of CW/BOA getting away with this crap. I'm tired of lenders screwing over hardworking people. I'm tired of these investors playing games with people over their loans. Enough is enough.

I'm curious to see how many other people will all of sudden have CW loan mods that are cancelled. Is this BOA trying to get rid of loans to clear out their portfolio or what? I find this all rather interesting given the timing with the BOA/CW merger.

I'll keep you all posted on my latest CW drama. Seriously why can't these people just leave us the hell alone?

Welcome back! Although I'm sorry it's under such frustrating circumstances! But, I'm not surprised at all. First, I love your site name. It's perfect! And your rant was excellent, so no worries about offending anyone (me anyways ). In fact, your rant made me laugh many times as I read through it! So, let it rip cwp! And, good for you re your very proactive response re emails, media etc. I think your lawyer idea is wise too. There must be some law or rule against consumer harassment or unlawful reneg on a contract or something to that effect re post completed loan mods. How the hell can you successfully complete a mod, only to have the clowns start harassing you a year under the guise there never was a mod. Wut ? THIS type of issue (the post "non-mod" mod horror stories and "shenanigans" by the lender "hooligans" !) needs to be addressed more closely by attys. Attorneys need to be made more aware of this type of post mod issue. There's a thread on this site "Ask the Attorneys" and maybe you could post there and see what one of the attys has to say. One's CA. Other FL. Both must deal w/ CW loans, so maybe they can provide insight. I've heard of a few other stories like this too. Nothing surprises me anymore about these lender clowns. How does one get that info? I keep being told by CW/BOA - not sure who's running the ship yet, that they cannot disclose that info. Yet they tell me it's the investor who determined my loan mod was cancelled and no longer valid. It just seems like one big circus to me.

I had them flato out lie to me that it was Bank of New York and then I had someone else tell me that it wasn't Bank of New York so I just contacted Fannie Mae and Freddie Mac and got pretty lucky because it was Fannie Mae. You can try those 2 first and go from there.

So just call and give them my loan number and they look it up. Sweet thanks for the tip. Lord knows we can't rely on any info from CW/BOA to be accurate. Jerks.

I had some issues with FAnnie Mae. I put in the info, got an email saying it was Fannie Mae that owned it and then someone from CW told me that it was incorrect so I tried again and Fannie Mae told me that they didn't own it when I checked online so I called them and said listen, I have an email from you confirming that you own my loan, why is it saying differently now? and the lady checked and said, yes we do own your loan so I cant imagine why it said that.

I'm not saying its the same for you but you can try calling. Maybe theres a glitch in the system like there was with me. Also, I read on here of other people calling BONY so you can try them. It seems like people started calling their own investors. I know that lots of here had BONY as investors, maybe your one of them. Also, I saw someone had Wells Fargo?

Or maybe just keep trying with CW until you get someone on the line that will tell you. Some reps gives a lot of info, others give nothing.

I understand completely what you're dealing with. Your situation is an exact mirror of mine. I congratulate you on taking such a strong stance on dealing with CW. Unfortunately, in my case, I've had about all I can handle from them and I concede. After taking the emotion out of this situation, I came to a business decision to walk away. What is the address/email/fax# for the president of BoA? I have looked on several threads, but haven't found it. I want to spell out all the lies I have been told. I found out yesterday that I have letter of intent. When I started asking questions, I was told the notice was sent out in Dec. It is now the end of May and I have never seen this letter. I was called a liar. I used to call every other day (from Dec-April) and not ONE person ever told me of the letter of intent. I am working with naca now. I tried to make a pymt w/ BoA yesterday, but they won't take my money now.

I spoke with the brain trust at BOA over lunch. These people are so incompetent it’s frightening. Really is there something in the water there? Or did they just bring over CW agents?
So agent says we have no record of a loan mod it never happened. I say yes it did. She says no it didn’t. And we go back and forth. She actually admits that many things were lost in the merger. Really no sh*7 sherlock you don’t say! She continues to check all her many systems they have – talk about an IT nightmare – eek. So then she finds some notes about a modification so goes and looks in the archive system and low and behold there it is. She says yes you do have a modification here it is. I say wow you’re really bright – kidding I didn’t say that, and agreed with her saying yes I do have a modification. That’s pretty much what my letter spelled out said but you couldn’t possible believe me.
So I say the modification stands as is correct. She actually has the balls to tell me that she is unsure of the plan at this time for our loan and senior officials will need to review it. Review what I ask her. The modification was done, signed, notarized and filed. Anywho she lets me know that I will need to provide a hardship letter, 2 months worth of pay stubs and bank statements and our financials. I can’t believe I have to start this entire process AGAIN.
In lieu of a hardship letter do you think they’ll be offended if I send them a picture of a donkey? I am just in awe over this one. Only in America can you sign a legal binding agreement to have it completely disregarded. I cannot believe it. Seriously they find the darn document in the archive and decide that it’s not longer going to be honored? WTF. The morons are going to pay for my therapy and medication once I’m done with them. Seriously I’m going to need to be tranquilized or something because I’m ready to come unglued. The appointment with the lawyer got moved back to next week. Hopefully he’ll have something to say but from what I’m hearing (mom works at a Law School) lawyers don’t want to touch these types of cases because of all dealing with huge corporations is a complete nightmare. Where in the heck is Erin Brockevich. I need someone with a pair to take these bozos on!

It's funny because before reading your story I was on the phone wiht CW asking why my loan which was modified in February is still showing on their system as 7 months past due and why the new payments are not reflected. Well this woman tells me thir was "issues" with my paperwork and the final completion or approval happened on May 1st. In this case this is the new approval date and it will probably take 60-90 days for the system to be updated. I am beginning to wonder if BOA is now trying to get out of these modifications made by CW. IT should be illegal but hell look at everything else they have gotten away with. That lady should have been embarrassed asking you for all the original paperwork again. Was there noone there with more authority you could talk to. I think I would have nailed myself to the floor until they honored the agreement. Just kidding but you get my drift... As for Erin Brockevich, try NACA. They may be able to take this case on as one of their more public stories as it really is outragious. Please keep us informed of your progress with these crooks! Good luck.

your story is absolutely horrendus, but dealing with CW/BOA it is to be expected. BOA bought CW in 7/08 and has owned them since then, the only thing that changed recently was the name from Countrywide to Bank of America Home Loans so don't let them use that merger bulls*** on you. We spent several months last year trying to work the idiots to no avail so we went with Naca and got a successful mod that was finalized on 2/6/09 however, we got a 2nd mod in connection with Naca on 4/7 lowering the rate to 5% sent the docs back and they have still not updated or fixed our account, I emailed Barbara Desoer's office and got a call within 2 hours and somone from that office is currently working on getting this fixed, however since I am still dealing with a CW/BOA person I have not gotten my hopes up. good luck

HOLY CRAP! I cannot believe your story! (well I guess I can....since it is CW/BofA we are talking about here)

I recently was approved for mod and sent my papers back. I am now waiting for my account to update and reading this I know my journey in this modification deal will NEVER really be over!
I will be very interested to find out what happens next with this....

Can you just keep calling back until you get someone who knows what the # is going on? I did that a few times ... called, stayed on hold as soon as the person answered, I could tell they would not be a smart one so I just hung up and tried again until I got someone with half a brain.

I, too, feel like I am losing my mind and will need to go into therapy soon! In my case, I am not only dealing with this loan mod nightmare but am also in the middle of a divorce, so I have to know some hard numbers here so we can finalize the divorce paperwork. Eight months of sheer hell so far...no loan mod and no divorce in sight yet!!!

Wow divorce and loan mod with the devil. You poor thing need a vacation or at least a stiff drink. That's just not fair my friend. Divorce is a PITA to begin with. I couldn't imagine that on top of dealing with the worlds biggest morons. I wish you all the luck in the world!!!!

We have seriously consider walking however with three kids, one of which is special needs, moving him would be detrimental at that this point. Plus we live in a high cost area where rent is going to cost the same as our mortgage. And with our credit in the toilet who on earth is going to rent to us? I'm going to give it one heckva fight and hope for the best. I'm still insisting that the loan mod stand as is. They apparently feel otherwise. I guess when we speak with the lawyer they can give some insight as to how we should proceed.

I totally agree! Everything CW does is illegal yet they get away with it. I would just keep on them like white on rice and don't let up. I figure if I don't get some results with the folks in the presidents office of BOA my next step is emailing - daily - the idiot politicians in Michigan that were voted in office. They need to do something for that paycheck so I have no problem bugging the crap out of them over this one. I think everyone needs to flood their elected officials anyways letting them know that CW/BOA is up to its old tricks. CW played nice last year because they were in hot water with congress and were sued by multiple state AG's. Now that BOA has stepped it's getting ugly again.

I just want to know WTF the tarp funds that went to BOA and all the other lenders are doing for people. Those funds were specifically earmarked to provide assistance to homeowners in a multitude of ways. I would like to know who benefited from those funds which is why I'm going to inundate my elected officials demanding answers. I know they are all in bed together but at least I can say I tried to make something that was seriously wrong, right. I'm tired of so many people being destroyed by these crooks.

Yes, I have had my share of morons lately! It's a toss-up which is worse....but I am leaning towards dealing with CW/BofA!

I'm pretty much done with it all and I have not even been through half the crap most of you have been though. I have been trying to get on this Obama plan now for 3+ months.. I was told I qualify for it and they had me on a "list". I called to see if I can skip 2 payments to pay the IRS but they told me no.. I need to stay current.. so I blew off the IRS (still filed taxes and made payment plan).. Weeks go by and nothing. Spend hours again on the phone and go through India "support" then to CW agent in US. They told me they had people on the plan.. but not for people with PMI yet.. so again I wait. weeks later and I get the same BS.. So I stopped payments. Weeks go by and now I'm getting hounded by the automatic robo calls to make a payment. Today I call back and get to someone from home retention (again) and they tell me they never hear of a list. Also that the Bank only mails the forms to people that qualify. I told him the 4 times I called and many people I talked too stated that I DO qualify. HE then tells me that it looks like I might?!!? He tells me to go to the USTRESUR.gov web site to see if I qualify... and then.... magically there is no one at BofA to call to make sure I'm on it. Ohh he also said that on his system I only called ONCE!.. F this.. I bought this house a year ago with no money down. ITs over a 100K over and and at 6 1/2 % . I might try NACA later once my account is 2-3 months behind (because no one will talk to me unless I'm delinquent).. So screw it. Why fight it... My plan is to stay in the house as long as possible and save. If I can be here for 6mo to a year I will have enough to be free of this bs and start new again. In 3 year after Obama is done running banks and auto makers and pissin our tax money away, then I might get a house again.. At a better amount and rate. I wish better luck for all of you, but sometimes the best thing to do after a fall is to get up and dust yourself offs and start new.

And you never get to speak to them???? Sheer insanity....." I told one CW rep that my negotiator is probably in India, she chuckled and said "actually he is." She told me I didnt need to call him "because he talks to only to investors" and I would be notified. I responded "Ok, smart one why call him a negotiator, have you ever thought of that? I mean it makes no sense, is that the new bamboozler? I mean even if you really are just reading what they tell you and you have no idea of the truth value. IT STILL MAKES NO SENCE, YOU LOOK LIKE A DUMB ASS FOR THEM, UR GONNA LET THEM DO THAT TOO.....Yeah I did.....Hey I've been nice for almost one year shy a week someone had to take one for the team....The insane clown posse of India are actually running lives of millions of Americans. awwww...Its like each one of us are in a prison cell, all talking about the injustice done to us, the only difference is we are not in cells???
