Face it they have the best of both worlds..your money and your home..

Your taxes from your income...they get as well cause all thier buddies in DC will see to it..

Then you get down to state level..they want money from TARP...Close your eyes and open your hand...WOW look a big fat check just landed in my hand...yeah now I can help all my buddies first so they help the working man get back to working so we get more money....

I called my contact at the State level. She said she personally did not file the regulatory banking violations but that someone else in the AG's office could have. She did one of the attorneys from BOA called and left her messages regarding our account. I asked if that means we should retain counsel and she said she didn't think so and that she felt it was a good sign that only senior management and the lawyers were working on my issue. I still don't feel easy about it and don't trust these mofo's AT ALL. Although the Michigan contact is very informative, works with the lenders every day and certainly knows her stuff. I'll just keep at it every other day calling, emailing, etc.

when you got the mod last year, was your online account updated to show the new modification terms?? Just curious if it was a complete reversal of the account and the modification or was the original mod never completely processed, either way it's sucks and is totally wrong and I hope you get a speedy resolution and come out of this with at least a little bit of sanity! But having personally dealt with the CW idiots twice for modifications it's a safe bet you will lose your mind, your hair or it will turn gray from the mass confusion they cause not to mention the other ills stress will do to a person. Stay Strong and don't give up!!

our account was updated and remained that way until May when BOA officially starting taking over. BOA at first couldn't even find the paperwork until they looked into the archive system. Of course there it was and they didnt' know what the hell to say at that point. Still working with the State of Michigan on finding a resolution to all this. I'm not giving up. They can seriously kiss my a## over this one. I've dealt with these fools for 3 years now and this crap has pushed me over the edge. I've contacted every politican and elected official I can. I have also contacted ABC News, Fox News, MSNBC, CBS and CNN about our situation. Needless to say I'm getting the word out there about BOA. We are also meeting with an attorney next week. Supposed to meet with him this week but the appointment got pushed back another week.

CW I agree...were not giving up either!!! I want to contact the news agencies also...this is mind blowing!! The stress alone is enough to drive someone nuts!! They ask..."why haven't you made a payment"? I have to laugh....they are the ones that had us "wait until the AG bill starts Dec.1" we waited.....couldn't make a pyment being in foreclosure...only to find out 9 months later our investor wouldn't comply with AG....this is just a big circus....they need to be exposed.

Well my fight with CW/BOA has finally come to end. BOA sent a letter to us and all the other 10,000 people I cc'd that they have reactivated the loan modification that was in place and all is well again. Well I wouldn't exactly go there because now I have to work on getting these idiots to report the information accurately to the CR but at least this part of the journey is done. I have no idea what will happen with the regulatory violation that Michigan filed against them. I guess I'm not privy to that info but I was pleased that this was all handled and dealt with in less than a months time.

For those of you in Michigan I HIGHLY recommend contacting the Michigan Housing Development Authority. These people are WONDERFUL and will absolutely go to bat for you. They call when they promise to call. They respond to email as they say they will. They hound BOA demanding answers and actually get them. I attribute my success to them because they were the ones who actually contacted senior officials at BOA demanding answers. Congresswoman Pam Brynes was also helpful. Of course my letters from Stabenow and Levin were worthless and nothing but BS from them talking about how they are going to help people in the future, blah, blah, blah.

For those of you still in the battle - keep fighting and never give in! I hope everyone gets results and workouts from these fools.

My battle with getting a mod still goes on. No update as of today, NACA told me to call again in 2 weeks. Last I was told to call in a week as we were at almost 5 months of waiting. Today I am told to have money from any missed payments, and balance of any partial payments ready in case an offer comes in. I am told Iwill need this to offer to CW/BofA when the send thru a mod offer. If I don't have all of this money it will go on back of loan (fine with me) but that we will then have to wait while they recalculate the new payment,starting process all over again. Not a good day today for me. But a wonderful one for you,it appears you have fought the fight and won!! Good Luck!

My NACA person told me this also....yet when the documents came in...the 4 missed payments are rolled onto the back of the loan, was not asked for anything other that the 1st new mtg payment.

I then called and asked NACA if should send what I have saved at same time as my new payment...was told no, just send a little each month after you send the 1st new payment and apply it to the principal. So, this is what I plan to do......

LOL I should have known my nightmare has not ended. These incompetent fools. Seriously I'm almost at the point of having a breakdown over this stress. These morons sent a letter to the Michigan Housing folks along with all the other people I cc'd but the numbers didn't match. So I contact my person to say hay this doesn't add up and she contacts BOA asking what the problem is. The modification is still in place however, our payment amount has gone up so of course they are doing some shady stuff AGAIN thinking we're just too stupid to notice. Then they have some a clown from the Chairman's office call me on Thursday who basically went off on me. BIG MISTAKE.

He proceeds to tell me that I am being unrealistic asking that they fix the inaccurate credit reporting and that I need to be patient and wait 90 days. Really because it didn't take you fools to 90 to report it all yet I have to wait to have my reports fixed because you suck. Yeah pretty much. So then he starts to get rude with me about my letter and how I needed to just be happy that the loan mod was fixed and quite complaining. He caught me on the wrong day because I had to light his arse up over that nasty comment and then hang up.

I sent my contact over at Michigan an email letting her know what I did and whom I spoke with. Also, cc'd Ken and Barbara on that email so they can see their employees are complete morons that are only furthering the problems.

I did receive a call from the AG's office wanting to know why BOA has not done anything to make our home more affordable and why they are dragging their feet on this. Hopefully they will contact the person I am working with over at MHSDA and together they can work with BOA. Needless to say I should have known I was not out of the woods just yet and that BOA would try and do some shady stuff because after all, they are the friggin anti-christ!

I got so fed up with the mod agreement that was signed, paid on, and then told it was denied that I got on this website and started reading. I got the email to the BoA pres and emailed my storywith scanned copies of the mod agreement dated 4/19/09. I sent copies of the recent payment BoA sent back and cc every elected officials email I could get my hands on. I did receive a call within a few hours and given his name, phone #, ext. # etc. He said he had my file and would have this fixed by the time he left in 2 hours and would call me back with verification. He actually called back and said I would have new paperwork within 2 days (identical to the original loan mod) and it would be settled. He said if anyone at CW called and said anything different than he has told me to have them call him at his phone number and extension. It made me feel better until I started reading again that even emails to the pres. and calls back from her higher up advisors could still not render a solution. Why have we all not called or emailed someone like Erin B. or the atty general. It is not legal to have someone break thier own binding agreement.
Is there hope that this madness will end even after involving the president?

It all makes sense now.. The light came on... BofA was given tax money to settle these loans.. if for some reason it take them a long time to do that what happens to that money? ................ interest... how much interest can a few billion make in a week? or month? hummmm Who knows.. Anyway, I Setup an account and had the first call from NACA a few days ago. The lady was very nice and even though they dumped allot of "to do's" , she was very nice and only took about 30-40 min. I have the second one coming next week, but I have to fill out 1) 2 member authorization forms 2) send them a mortgage statement 3) 4506T form (something on their website) 4) A hardship letter (thats going to be fun) 5) property tax bill 6) proof of HOA 7) Annual Prem home insurance I called BofA and got a Statement. and it looks like it has the upcoming county tax for 11/30/09 ($1892.00) and 3/31/2010 ($1892.00).. also looks like the insurance is shown. $673 /yr...is that the info they need? While NACA is working on that I have been keeping in semi contact with BofA. They seem to call me all the time even after I told them I cant pay, they will call the next day.. haha One girl I talked to a few days ago ran some numbers and said that it looks like I can get on the MHA plan and said they can cut my interest to 4.8% and it would knock my payment to $1975.00/mo .. Thats about $175 less then I pay now. For me I'm stuck in a halfway house. I bought this house 2 years ago with no money down. I'm in Stockton,ca where there are so many houses for sale and I'm about 75K-100K down. I doubt I will be able to get 2% interest with BofA, but hope NACA can do it.. If not even with my jacked up credit it might be better to have the wife get another (cheaper) house under her name since she signed a wavier when I bought this house. Even though she doesnt have much history.. After I finish paying mr. irs man then I might be able to save and maybe she can get the 8K for new home buyers.. who knows.. I'm just tired of playing games with them all.

Before I actually apply for my Modification......

My gross income is 42,000 last year and 22,000. the year before! YIKES.

My NET WAS basically 1500.after deductions... I am a realtor....

So far As of August 31st 2009 I will have grosssed 25,000. ( pathetic I know.)

My principal is 383. interest only payment is 2000. taxes and insurance another 550.
40,000 IN cc DEBT. 750 a month min payment, in addition to 1200 other monthly bills... ( at least)

I AM CURRANT.. ( SOLD EVERY THING BUT MY BODY TO STAY CURRANT, THE BODY ISN'T WORTH MUCH THESE DAYS.)

MY PROBLEM I BELIEVE IS THAT I DON'T EARN ENOUGH TO JUSTIFY A MODIFICATION......

Will they calculate my Credit card minimum payments as expenses? What if I go bankrupt, will that give me a better chance of getting a mod?

1: IF I GET A SECOND JOB can THEY USE THAT INCOME, EVEN THOUGH IT IS A NEW JOB? I HAVE A SMALL FARM, I AM TRYING TO GET HORSE BOARDERS, CAN I USE THAT AS INCOME IF IT IS A NEW SITUATION?

2:WILL THEY ADD BACK IN SOME OF MY DEDUCTIONS GIVING ME MORE INCOME, or are they going to say your net was 1,500, you don't qualify for a tent! I DEDUCTED TAXES MORTGAGE INTEREST ETC... CAN'T THAT BE ADDED BACK IN?

Before I apply I want to know how to present my file...ie 1000 a month from horse boarders, roomates 2nd job? Will any of this help???????\

Be careful about filing bankruptcy. In some instances, that will preclude you from being considered for a mod. I have even read where the lender has to do another type of review if you file a bk before you are approved for a mod.

Some new state laws regarding mods also preclude those who have already filed a bk from being put in the group that is to be helped by the changed or added statute(s).

WOW, you seem to have the exact same CONTRACT that I was offered by CW and then, after everything is verified, they refuse to honor it. No REASON provided, no contact from them. They transferred the note with it taking effect the same day the first modified payment was due. They refuse the agreed-to payments.

I don't know if you have by now gotten this contract honored. I have found a way that apparently DOES work. There are other websites with info on an Ohio guy who has the same problem too. We both have attorneys working this. It may become a class action suit. Also, ours both fit the California AG's settlement type mods for CW loans. I'm putting a complaint in with 'Uncle Jerry' this week. Your mod looks like the same thing.

Did you get a resolution? If so, did you file suit to get it?

I just hear on the radio 2 days ago that The Gov gave them money to modify 3 million homes and only 150K have been done so far. why are they holding on the money? why are they dragging all this out and screwing with people? They want people to let them string this out and BofA gets their houses and messes up their credit. That way they keep you down for a much longer time, possibly needing high-priced credit when you do start making any come-back.

This is exactly what I fear, that trying for the mod will destroy my credit, and I will still get rejected! I know I will get rejected because my income is too low! Yet I have managed to pay my mortgage on time everymonth... but this means NOTHING! I live in poverty to keep my credit scores up, but I am still too great a risk for them to modify my loan! Someday I will walk away, and you can be sure I won't do a short sale or turn over my deed TO SAVE THEM MONEY.... they can fight me for 2 years!

Well, they (BofA) are settling cases to keep this mum.

Did you guys see that case that was in court in N.H. where the couple were
strung along about qualifying for a mortgage for soooo long that they ended up loosing their house?

Well, that law practice indicates the litigation is over but THEY CAN'T TALK ABOUT IT.

THAT MEANS THERE IS A SETTLEMENT FROM BofA STIPULATING NON-DISCLOSURE.

THIS COUPLE DID NOT EVEN HAVE ONE OF THE MORTGAGE CONTRACTS THAT BOFA IS REFUSING TO IMPLEMENT.

Anyone with one of these CW mortgage modification contracts needs to file with a number of agencies. Please pm me over at Bankruptcy Forum where I am 'socalgal'.

I also notice that Litton and Saxon are also issuing mortgage modification contracts that they refuse to implement.

From the NH case where BofA/CW lawyers stated that the info the company puts out to the press and in commercials about offering mortgage modifications was 'puffery', things they admitted they NEVER intended to actually offer: we can draw a similar conclusion with the actual mortgage modification CONTRACTS - THEY NEVER INTENDED TO HONOR THEM.

Now that violates the whole principle of truth in lending AND basic contract law.

The AGs and the banking regulators need to sit CW/BofA, Litton and Saxon haunchos down and then bring each of them out a stack of the clothing federal prisoners are issued. Then tell them they are not just breaking state but also federal law.

I know we can't expect Barney Frank's pals at the federal level to do what they should since Barney got his own 'pass'. But the concerted efforts of the AGs would have a chance.

We need to get the CA AG to look at the breaches of the CW 2008 settlement.
