affordable home package?

We have been trying to get help with CW for about 5 months now, we have always been on time with our payments, but have been hit hard this year with extreme hardship. we lost 2 brothers and my mother in one year and then the worst..We lost our 26 year old son in June of 2008 and now my husband is on disability for depression. We make enough money to pay our expenses, but we now have nearly 2000 dollars in late fees. we are never going to be current at this point. I have called to ask about the possibility of them waving at least some of the late fees but they will not budge. These people have no compassion at all. we don't qualify for a modification, we have a fixed 30 year loan, we are underwater by about 100,k any suggestions on how to handle this? we just want to be caught up. right now we are in something called a loan forbearance process that we should hear something in 30 to 60 days, it has now been 40 days. any help would be great.
thanks
Julie

Re: loan forbearance

Julie,
Glad you found the forum and posted. I am sorry for the loss your family has gone through.
Since you are in a "loan forbearance process" I will assume you have already contacted CW with a hardship letter.

No, thery are not very sympathetic..they are concerned with making as much as possible.

You may want to contact NACA:https://www.naca.com/refinance/refinanceSubmission.jsp They are a non-profit homeowners advocacy group that is HUD approaved. There is no cost. WHen you go to their site, it will explain how to set up an appointment with a counselor, and they will then contact and negotiate with CW on your behalf.

Hang in there! Let us know what happens!

Re: loan forbearance

So we are now waiting for a forbearance letter and it has been nearly 60 days, we were told we did not qualify for a cw mod. we have negative income. I have not gone any further with Naca mostly out of fear. at this point we are doing everything we can to get current with our payments on our mortgage. my question here today is, we have not paid any CC payments in nearly a year and need to decide rather to file a BK or to try a debt company like CCC. does anyone know how this will affect the new Obama plan, or how it impacts Naca willingness to work with us? this is way to much stress....

Re: loan forbearance

jdubu2

We are current on our mortgage, but not paying credit cards, no money left at end of month to do so, due to husband being laid off.

We are working with NACA, and they know we are not making credit card payments. They know that we had to choose what was more important, credit cards or our home. We chose the home. Also, NACA told us to make the house payment as long as we can, even while waiting for them to get our restructure complete. They told us that by doing whatever it takes to make a mortgage payment, even if it means not paying cc, it would look to CW that we are serious about wanting to keep the home. Of course, we have managed to make the mortgage payment, but not sure how much longer we can do so. Payment now takes over 50% of income.

NACA just wants to be able to help you keep your home, and at a payment you can afford long term.

I am fed up!

As most of you know I have been trying to get a forbearance through CW since 1/09 up until last week, it said active processing. now I can;t see anything. nothing in our lives have changed my husband is still out of work for p.t.s.d. after finding our 26 yr old had killed himself, we have been back and forth with these so called helpers! I am at my wits end. I can't file for a chapter13 because we don't make enough and now it will cost us 1500 to file a bk in which we have no clue where to start! I am so beyond frustrated right now, NACA wants bank statements that we don't get, we don't have a printer and I am really feeling overwhelmed, I am trying to do this my damn self since no one has a clue here what I am talking about. then CW sends ne to India!!! like thy are going to understand my plight...
anyway.... where do I start.....

re: affordable home package?

I talked with some guy named David, I think they may all be named that. after a long drawn out convo, about how we were supposed to have received in writing for the forbearance, he told me it was cancelled it because we did not return the paper work! what paper work?? we get every other then else they send. So after a min on hold he came back and said that we could go into a repay plan you pay $800 on top of your $2435. payment for 9 months! I said are you fing kidding me! we can't pay the payment we have now, all I want is a modification! I am willing to call Barbara from the presendednt of BoA and see where that gets me. needless to say he put me on hold for about 3 good min,. and came back and said congrats! you are going to qualify got a home modification, I said when will I get the paper in the mail and he said about 10 days.... so the waiting game is on.. can't wait to seewhat crappy thing they will offer us.

I don't think it matters, I am figuring that they will see I am not paying mine too, when dh lost job for months we had NO income...just what we had in savings and I held on to it for food and utilities...I am working directly with CW and if they hold that against folks then I am afraid there would be a lot of people that would not qualify...try not too worry too much, I have seen a lot of post like yours. I am so sorry for your loss...I just cant imagine.....

re: affordable home package?

jdubu2,

Hang in there. My modification took 6 months to complete with CW...I called every week for that long and didn't get the same answer twice...

As you have experienced, sometimes being persistent can you get you a result that seemed impossible earlier. As long as they keep your request in active processing, you are good. Sometimes my info would disappear online, and I would always call just to be sure that nothing had been cancelled. Stay on top of them, and you should come out okay in the end.

Best of luck to you!

re: affordable home package?

jdubu2,

I am sorry to hear about your loss and family troubles....it is unbelievable that the banks ask us to be proactive when there is a hardship, then they do absolutely nothing to help. I find it unconscionable in your case.

One thing I wanted to relay is that you can't believe anything the reps tell you over the phone!! The first few times I called last Oct 08, they were nice as could be. One rep (from India, no less!!) told me what my exact payment would be after the modification and that I would receive the paperwork in 10 days. Needless to say, she was way off! I didn't receive loan mod until mid Feb 09 from CW. The mortgage amt was almost double what she the Indian rep stated! Totally unacceptable! I don't understand it....these phone calls are all taped! Many of the reps said I wouldn't get a "real" modification until I was at least 2 months late with payments....I asked them for the ID # of that last phone call telling me that. I dunno why....in case I need it for a class action suit against these clowns??

Anyway, go with Naca at least they are honest about what they tell you and there have been many success stories posted after working with NACA. I hope we are all in that forum someday soon.....

re: affordable home package?

Thanks for all your support, this is the 2nd hardest thing I have been through. losing my son, not quite a year ago was the worst day of my life, nothing will compare, but it has given me strength to fight these SOBs until I am forced out on the streets! my son was just 26 he had no drug or alcohol problems, he could not stand the way people treated each other, he used to tell me "mom it literally tears me up inside" I would just tell him to do what he could by helping those he could.... it was too much and I did not see it coming at all! my husband and he worked together in the mountains of California so they were gone all week, I talked to them everyday.... Thursday Marcus stayed at the cabin and he told his dad maybe after lunch he would feel better, my husband went to check on him and he had shot himself..... this has devastated our family more than anyone could know, losing the only memories we have of him here.... anyway I am sorry for all the info, It s just really on my mind. my husband has not been the same man I married and I don't know that he will ever be.

I really hope that you can find a way to get your home payments at an affordable payment. For me NACA has been a savior! I wish you good luck and many good thoughts sent your way.

affordable home package?

We received a fedex today from BofA that said we have a trial 3 month modification plan our payments are reduced nearly half for 3 months starting July 11th. it seems odd I have sent them nothing in documents, but it states based on the information they have we qualify for this until they get more documents and hardship letter. we can prove we qualify, but has anyone else received anything like this? I am not at all trusting of CW/BofA we are 2 months behind and have been turned down twice for a mod. in January... weird. maybe they finally grew a heart?

This sounds like the Obama/Government Making Home Affordable Plan, it has a 3 month trial period in order to obtain the modification.

here are the details

Re: affordable home package?

Hello jdubu2,
my heart goes to you and your husband. nothing compares to losing your childs life. it must be incredablly hard to deal with at this time. stay strong. know that Your Son is with you always, and supports everything you do. you are not alone. we all love you. I hug you and wish you all the best. family and friends really are everything. we are all in this together and wish the best of life to each other. that is what we all seem to be learning. i realized today that i had quit loving my home while in this process and that making alternative plans for future was taking away from loving my home. I want to stay in my home and will keep up the good fight. and i am loving my home again. keeping it sparkly and clean are part of that appreciation. be in each moment. love your home while in it. and if life offers another path, hey, it could be pretty interesting. i was ready to give up yesterday with the ridiculoius loan mod from boa at half of what I need to stay, they suggested i contact other creditors and see if we can work on all aspects. I will do that, and am responding to there offer that is what I am doing, but there offer is not enough to keep me in home. i will propose to them what i think is the amount i need to stay in home and keep mortgage balance which is probaly 100,000.00 more than home is now currently worth. i have not written my response letter yet, i am now 4 months behind. i am realizing every person that i talk to on boa behalf is only doing the best that they know how to do. we need to make a win win situation for everyone and getting upset with the servicers does not help issue. i will keep pointing out the win to them and see if that works.
love to you and your husband
