CW/Bank of America Frustrations?!

I apolgoize if someone else had a similar question....
I called BOA on Saturday to schedule 2 payments but was told I was in pre forclosure. I spoke to the gentlemen on the phone, and we went over my financials, debts etc, and he informed me that I qualified for the Home Affordable Modification Program. He instructed me what to gather together, my hardship letter, and where to fax it. Today, I got it all together. I called BOA as I didn't have my loan number on me and of course a different representative answered the phone. She seemed to have no idea what I was talking about, and I explained all the notes I took after Saturday's phone call. she said "oh well...I guess go ahead and fax it and see what happens". Now, I hardly have a feeling of comfort after this exchange. I'm not sure now if I should be calling someone else? I just faxed the info, and he did tell me on Saturday that it could take up to 30 days, however in the meantime today's representative told me the home is in foreclosure and remains that way and they wont take any payments except the entire amount to brint it current. So, do I just wait to see if they approve me? In the meantime I'm on pins and needles wondering if they will be selling my home at the auction next month. I'm in Atlanta Georgia. I'm not sure what else I can do here....or other options. I now have the income to support the mortgage, however the behind payments are hard to catch up on. I definately want to work this out with them.....

It sounds like the first time you called you got someone in loss mitigation and the 2nd time from the tone of the conversation that you have described it sounds like they are in collections. In collections all they care about is to get a payment from you.. period.

Keep calling and make sure when you talk to a person that they are in loss mitigation and not in collections..

Call BOA and ask who your Loss Mitigation counselor is. I went thru the same hoops when I first started the process with BofA. Once I found out who my LMC was I got his direct number and I only call him. The reps on the main number only go thru a script and need you to push them to dig deeper.

CW/Bank of America Frustrations?!

I'll save you all from a long story since it isn't that different from anyone else, but looking for some guidance here.
Since last year after going back to work, I've struggling to keep current on my mortage with CW. I'm currently at 7.5% at close to 2800.00 per month. I would fall behind a month or 2, get caught up, fall behind etc., just never made to the point where I was current, but kept myself out of trouble I suppose. Well that came to a head this past Saturday when I called CW to schedule 2 payments and was informed that I was in "pre-foreclosure", but there was no sale date. I was shocked, as I had not received any notification of such (not sure if they are required to or not). I spoke with a gentlemen (wish I got his name), who said he would take current financials over the phone, he then came back on the line and stated that since I have about -250.00 left each month, he thought I qualified for the Home Affordable Modification Program. He explained everything I need to gather including the hardship letter, and told me to fax it to a number but it would take about 30 days for a decision.
Yesterday I went to fax all the info, but didn't have my loan number handy. I called CW and of course a different rep answered who seemed to have no idea of what I was talking about. She informed me that if I did qualify for that program I would have already gotten a letter but said(and I quote) "I guess go ahead and fax it in and see what happens". She did state that they would hold off on a foreclosure sale date at this point (but not sure I trust much of what she said...as she sounded like I was bothering her). She said she could request a "reinstatement letter" in the meantime as that's what I should do to "forget this mess" as she called it. She instructed me to call back in 72 hours for the letter. I'm not sure how long they give you in those letters to come up with the funds....but we'll see.
On the way home, I decided to call again and see what other alternatives I have availble to me should this not work out, as I do want to stay in the home and really want to work this out. She stated I needed to wait to see if I was approved and it could take awhile, but perhaps I could do a forebearance...but not a standard loan modification since I'm in a negative each month. I'm in the process of scaling down some of those monthly expenses now...hopefully to make up that difference, but due to my damaged credit when I needed a car last year, I bought a used one and am at 15% interest with a 786 dollar car note...wish I could get rid of that!
So I guess I'm looking for some advice...as I'm not that comfortable that CW/BOA is giving my request any creedance....is there any other organizations that can assist someone who now has the income to pay the mortgage get current, or renegotiate for a lower rate or anything at this point...even give me a grace period of a few months and tack the deliquencies on the end. I now owe January through March....so I'm just worried the longer I wait, the more I owe...and that one Tuesday in a coming month my house will be at the auction block! A reduction of my monthly payment would help SO much. My mortgage right now is at about 38% of my monthly gross (as I took a salary reduction when I went back to work)
Any ideas or past experiences or advice would help...I'm so upset and embarassed about this situation, but really want to work this out and keep my house.

You may want to contact the NACA (Neighborhood Assistance Corporation of America). If this is the only property you own, they may be able to help you with a forebearance program (or something better). They are a HUD approved, non-profit organization that have helped many of us here (including myself). Their services are free. Below is a link to their HOME SAVE PROGRAM. You will have to fill out the online submission, fax some paperwork and then schedule a phone counseling appointment. They are here to help and very compassionate. Please check it out. If you have any other questions, the members here are very helpful. Several of us have been through the process.

SO can I begin the process with NACA even though I "applied" for the Modifcation through CW/BOA? I'm assuming they have done nothing with my paperwork yet anyway...just didn't want to duplicate efforts or negate something.....not sure how this all works...certainly is a lot to take in! I'm curious how other NACA stories went. I'm certainly willing to work this all out....so anything that can help would be great.

Good Morning Rjatl,

I would suggest starting the NACA process immediately. There is nothing wrong with having a "Plan B". Personally, I believe that CW/BOA will not offer you anything better than what the NACA will be able to accomplish for you. They have helped many of us here. Take the time to read some of the success stories listed on the home page of the forum. The NACA was able to reduce my monthly payment by over $900.00. My loan is now fixed at 2% (for the life of the loan). That is amazing! As you browse the forum, you will see how fantastic this organization is. The process is long because they are so overwhelmed right now, but the wait is worth it. Please give it a try. Again, the members here are very supportive and well informed on the process, so we can help you if you have any questions.

thank you for the advice. I most certainly will look into them today. I checked out the website yesterday...so today will start the process of filling out all the information. Hopefully once they are engaged I may feel a little releif...as with CW/BOA, I still feel very uneasy. Though they did tell me that the sale date was frozen, no one could tell me if they would re instate it or not and when. They also wont allow me to make any payments in the meantime since it was in pre-foreclosure...(though I would have thought they would rather something than nothing), but understand they have their regulations. 2% for the life of the loan? that's AMAZING. I'm at 7.5 which now adays is rather high...but if it could be reduced, I know I could keep the house.

Rjatl,

When you go to the NACA website, you will see a link for urgent situations :

"If you have an auction date click here for Sale/Auction Dates and NACA will work to suspend it to provide an opportunity to assist you."

The NACA has been able to postpone sale dates for other members here. Hopefully, they can do the same for you and possibly expedite your file.

Thank you so much for the guidance. I'm on their site now. I don't currently have a sale date as CW/BOA said they have put a moratorium on them until they figure out the Obama housing plan....but again I don't have much confidence in them at this point...since I never recieved any notificatino of even the pre-foreclosure...who knows if they will schedule it again...!

Just my two cents before I head out the door, lol...What CW/BOA says and what CW/BOA actually does are two different things. I hope they did suspend the sale date, but please do not assume they did because they "said so".

Have to go to work now. I'll check back in early this evening.

I finally completed the online submission for NACA and provided all my documentation and montly debts etc. I have a phone appointment on Monday at 7 pm. Though I'm still upset and stressed about this all, I'm glad that at least on Monday I can speak with someone who may be able to help as opposed to CW/BOA who hasn't been much help in the past week!

they did notify me yesterday that they tried to reach CW to stop the sale (last thing CW told me was that all sales were suspended...but then another rep said "she wasn't sure). Brilliant training they give them there...but at least I have the appointment on Monday. I'm hoping something positive will come of this! Thank you for your advice FLgata!

CW has a dozen different stories to tell. Seems like you can't get the same answer from any two people.
NACA is very good at what they do! I will be waiting to hear your story and how it went with them.

thank you! yes...I think my CW story isn't much different from anyone else. They asked me to fax the AHM paperwork..I doubt it's even left their fax machine yet. So I have no confidence that they actually did suspend the sale date yet...it's amazing that they function like that!

I had the first phone appointment last night with NACA. He asked for a few more documents to be faxed to them, but said they would review after receipt and should be ready to submit to Countrywide. He did at that point schedule another follow up phone appointment for Thursday morning at 8am. I just hope they are able to work something out for me. The rep seemed a bit impatient with me at first, but I'm assuming it was a long day for him...since the call was at 8pm so I didn't give it much credence...and by the end of the conversation his tone had changed....so I'm keeping my fingers crossed for this one!

Good luck, rjatl! I'm in GA too, just north of Atlanta. I originally faxed all my docs to CW, in early April, and my account status on CW/BOA website says that my 1st mortgage only (I have a 1st and 2nd, both with CW/BOA), is in work-out process, all collection efforts will be suspended, blah, blah, blah.
I also contacted NACA though after reading the nightmares that everyone seems to be going thru in dealing with CW/BOA. I have submitted all my docs to them, and have an appt. tonight at 10:00 p.m. Hopefully after tonight's phone appointment we should be ready to submit to CW/BOA.
We currently owe April and May's payment, but I am a bit nervous because of GA's foreclosure laws. I don't want to get too far behind, and hopefully we can come up with April's payment soon, so that we are only 2 months behind until a modification comes thru.
Keeping my fingers crossed for us all!
