I went into a chapter 13 in Feb 2006. During that process, I lost 1/3 of my income when my disability was stopped for review. That is a whole other fight that has been going on for years.
After notifying the BR attny, he said to keep making the payments to the BR court. So that continued for two more years while keeping up with the mortgage payments. I didn't start to get behind until last Summer. Now I'm about 2 months behind.
According to CW, I'm in a workout but they can't talk to me until the status on the mortgage gets changed from BR to normal(?). It was discharged in Jan. this year and they have the Discharge Order I faxed them. It's date is the 20th of March.
1st and 2nd mortgages combined come to about $1500 per month. Not a lot compared to some I know, but I only have a $3000 per month income. I have cut all expenses everywhere they can be. Have a phone interview with NACA tomorrow morning. Will see where that leads. I also have a request in with CW for a straight up refinance and they are supposed to call sometime. Not holding my breath on that one.

Thanks ***. Well, 9am came and went as did 10am. I remade another appointment for 2pm Thursday. I will try calling before then and try to get the interview done.
I really don't hold much hope that CW will try to do anything. Even just a refi at the new lower rates would do it. I've applied with them, so the wait will continue. I keep making about 50% of the payment each month. It's all I can do. I end the month with less than $25.00 after food and bills.
When I get any changes, will post them.

dont give up oldguyhd. The process is long and can get very frustrating at times. Especially with the first initial stages like the phone interviews, but NACA can get it done. I am an example!!!

thanks teenut. You have no idea. It's just one more bump in the road. I've been fighting Social Security for 8 years to get my disability back. Been through a chapter 13. Personal Injury law suit. All in the last 14 years. I have to admit, I am starting to get tired of it all. Everything you have to learn just to get through is impossible. You don't have to be JUST a Lawyer but a specialist in every field!
Back on track, have another phone appointment for Thursday.
I had never even heard of NACA until I found this place about 2 weeks ago. I'll keep at it. I may not always win, but I never give up..
No change in my status at CW and they still won't talk to me until maybe the end of the month.

I had never heard of NACA either until the stumbling on this site. This site is such a good tool. Read up on as much as you can and ask as many questions as you can. Educate yourself on the process. This site will empower you. Everyone is here to help. It makes you feel like your not alone. We all go through the ups and downs together and it doesnt feel so bad. Just being able to blog about it will give you a little relief. I have been helped so much here and I want to pass it on with the little knowledge I have gained. We are all here to support you!

Well, all documents are faxed in to NACA. At least until they call back on Tuesday. There might be more needed, but can't think what else it could be. Too late to send in the first, second, or third born. They've moved out! (for now)
I got the CW statement this week and they asked if I wanted them to continue sending statements? What's that about? And from what I can tell, they have NOT applied any of the payments I've sent in since Jan. this year. AND if you take the amount on the ch13 papers when filed, they did not apply any of the payments made during the ch13. Started the 13 at 142000 and according to CW I currently still owe 134000. That's after making 30 on time payments at 1100 per month.
Maybe my old school math can't cut it anymore..

Spoke to NACA again today. Faxed in the last of the needed paperwork. They will call in the morning to verify that they received said papers. They will then file it all with CW. They are trying to get my payment down from $1100 to $790. That will help a lot, but I still have to do some kind of workout with 2nd mortgage holder Fifth Third Bank. Will call them tomorrow and see what they can do to help. If they can come down 30% like CW, I might make it long enough to either get my disability back or sell the place. Time will tell.

Talked to NACA this am. Change of plans somewhat. Payment to be lowered from 1078 per month to 546 PITI. Can't get much better than that. Was also warned about NOT signing anything sent by Lender without checking with NACA first.
Have called second mortgage lender this am also. They will be sending out their package UPS for mod application and forms. Will keep posting updates as they happen. Hang in there everyone!

Counting the holiday weekend and a couple missed phone calls. It only took 4 or 5 days to get the package submitted to CW. Has not been approved by them yet, but it is expected to be 4-6 weeks or less. Was only submitted today.

Exclamation So much for making sure they get their papers.

While waiting for the Bankruptcy Court to send the "Discharged" documents to the lenders on my mortgages, I could not get any mods started. After FAXing the docs in and multiple phone calls, they finally acknowledged that they had them. They (Fifth Third Bank) sent out a mod package the next day, right after the first call from their collection dept!! And they called again the next morning. Stated that just because the mod was in process didn't matter. They would be calling me every day trying to get 1700 from me. Well, good luck and get in line. The package arrived the very next day and will go back tomorrow. Collections made the statements that they will continue late fees and turning it into credit bureu as much as possiable. I don't know, after completing the ch 13 in Jan 09 just what other damage do they think they can do that I haven't already done myself? Kind of an empty threat at this point in time..

I always laugh when they say they will continue negative credit reporting if I can't pay them...They have been reporting me negatively since last year, my score probably can't go down any further

Even though my modification has been going on for almost six months and I call EVERY week, they still ask me pay my past due. It's like the rep is hoping that I'll just say, "Oh, okay, here's 9K. I was going to keep it because I have been enjoying making 100 plus calls to your department, but I've had my fun now." Sure. And the modification I applied for: don't need it, just thought it would be a good idea to completely trash my credit for kicks....

You're sitting on 9K?!?! You can't possibly have had all your fun yet if you still have that much left over. At this point I'm about ready to tell them all where to go and take myself and money to Mexico. I hear it's a bit warmer there so I can leave the snow shovel for the next owners to enjoy. I just have to keep thinking that it will either get better or I'll have to learn Spanish!

Still nothing from CW but it's early. Not even a nasty call. Still getting the nasty calls from the second mortgage people. While they are doing that, I'm getting homeowner help papers from the workout department. They should have all the papers today, will call tomorrow and make sure. I will also see if the workout department can get the collection department to get off my back. I started sending them hardship letters and other documentation in Dec 08. As long as the ch 13 was on nobody would talk. Now they all want to talk/threaten every day several times a day as late as 8:30 pm.
Still hanging on..

Well, they got all the papers and will get back to me no later than tomorrow with an offer. They have already called several times this week to verify documents. I'm also still getting the automated calls from the collection department 4-5 times a day. At what point does it get into a level of undo harassment? Don't care anyway. I'll just go to my woods and pick morel mushrooms in stead of sitting here screening calls. If I don't find more mushrooms, I can at least come back with a collection of ticks!

Success with second mortgage! Fifth Third Bank called this morning and said I qualified for the modification. The mod drops the interest from 9.15 to 5%. It will lower the payment from 477.71 to 233.07 for the remaining life of the loan. The paperwork will be UPS to me for signature.
Looks like I'll have some reading to do come Monday. Was also told that since I sent in the partial payment this month, all I have to do is send in the papers before the end of the month.
If NACA comes through with the first mortgage at CW, I should be able to stay here. I might even be making it if I can get my disability back! I'll have time anyway.

Thanks CW California. No paperwork on either loan mod yet, all verbal. The second mortgage from Fifth Third Bank should be here today. With them down from $477.71 (9.2%) to $233.07 (5%) life of the loan and if NACA can get the mod from CWide down from 1078.00 to 549.00 I'll stay here awhile. One thing for sure is it's too much house now. It was big enough to raise kids in, but the upkeep and maintenance are going to be too much to do soon. Let the market recover and level out, then sell out. Back to being a renter somewhere, maybe.

Paperwork is done and gone on the second mortgage with Fifth Third. The new payment is in place already. Still nothing from CW for the most part. They keep saying that it is with a technician to change the status from Bankruptcy to normal. They also say that person has thousands of them to do. So get them some help!! The guy I spoke to was a little miffed when I told him I didn't really care how overworked they were, as far as I was concerned I was the ONLY customer they have!
Will keep waiting on CW. I'm guessing that I'll hear from their collection department when they get the coding changed to normal. Another week and I call NACA to check status. Hang in there all...

Big change in "Status" on the CW/BoA account today. For weeks there was no change in status. As of 6/8 they have received paperwork of some kind that has now put me into modification process. I'm pretty sure it was the copy of the letter I was sending to my Congressman, Senator, AG, NACA, ect. Or it could have just been the tech getting my loan status changed from Bankruptcy to normal. Might also have been that they didn't get a payment last month or this month yet. We'll see.

"Your request for assistance is under review. During the review process, a thorough examination and analysis of your loan will be completed. During this time, we may or may not need additional information from you. It is common that you will not hear anything from us during the review period, but please be advised that all collections activities have been temporarily suspended during this review period. We expect more information to be available on 07/10/2009. If your status remains unchanged after the 07/10/2009, please call and speak to a customer service representative. Well, I won't call it good or even bad. Here is the latest on the site as of yesterday.

Workout Status Details: Your Loan Modification has been canceled from workout servicing due to a bankruptcy filing. Please continue to explore alternative options to bring your account current through your attorney and the bankruptcy court. If there is any change in your financial situation, please call for reconsideration. Thank you.
Information as of: 06/19/2009
Workout Stage: Canceled
Phase/Sub-Phase: Bankruptcy Filed

The big catch is that the bankruptcy was filed 3.5 years ago with payments made on time until about 8 months ago. The Chapter 13 was completed and discharged in Jan 09. Countrywide received from me the copy of the court discharge, even admitted it on hand, on 29March09. They even got the copy from the court on on 22apr09.
Problem is that ALL I get is automated response telling me to go through my Attorney or the Court to get my account current. I believe I'll be going to a BoA office on Monday and see if they can get LIVE people to correct this and get in contact with NACA from now on. I don't think I will be talking to BoA anymore.
I keep thinking that they can't possibly screw this up any more, but they continue to surpass my wildest dreams!
