    Modification approved then taken away!!!

    On there website, we were approved for a modification on 3/22/09. They sent us papers to get notarized on 3/6/09. Got them notarized, sent them back. Received a phone call this last week and was told everything was okay. First payment do ,
    May 1.
    GUESS WHAT? RECEIVED A PHONE CALL TODAY, SAYING THAT WE DID NOT QUALIFY FOR A MODIFICATION. I TOLD THE PERSON, WE RECEIVED PAPER WORK AND ON THE WEBSITE IT SAYS IT WAS APPROVED ON 3/22/09.
    HE SAID, AS OF 3/29 IT WAS NOT APPROVED AND IF I HAD ANYTHING IN WRITING AFTER THAT DATE. I DON'T.

    NOW WHAT AM I GOING TO DO. HOW CAN THEY DO THIS. APPROVE YOU AND THEN TAKE IT AWAY. WHAT THE HECK.
    WHAT AM I SUPPOSED TO DO. WE HAVE BEEN TALKING WITH THESE PEOPLE SINCE JUNE. WE HAD A HARDSHIP CASE. OUR SON WAS IN CAR ACCIDENT, INJURED HIS BACK LOST JOB AND HAS 3 KIDS UNDER AGE 7. THEY ALL LIVE WITH US.
    PLEASE, CAN SOMEONE HELP US SAVE OUR HOUSE. They can get a bailout, but they can approve you then take it away.
    HOW CAN THEY APPROVE AND THEN TAKE IT AWAY!!!

    I am so sorry to hear that they did this to you........

    If this is the only property that you own...........you may want to do what other members have done and bypass the CW BS by going through NACA instead............you may get an even better modification then you received through CW..........NACA modifications are low fixed rates for the life of the loan............and they are a HUD approved counseling agency.......

    Did you provide the proper income verification with your papers that you returned?? Did you possibly have more income then you initially told them? I do know that the mod papers say it is contingent on your income verification. At least thats what mine said.

    I would also suggest contacting your attorney general. I just did this because my mod was to have been effective Mar 1st. they still dont have naything updated in the computers. The attorney generals offic ei going to be contacting Countrywide on my behalf since it is past my modification effective date and nothing is showing updated in their compuers.

    We did everything they asked. The papers actually say," We are pleased to inform you that your loan modification has been approved. In order for the modification to be valid, the enclosed documents need to be signed and notarized. I just don't know what to do. i did email our Attorney General, as ours was one of the states that sued Countrywide. Please keep on with the suggestions, please.

    Mine also said it was approved, but it also said to mail in the paystubs, again with the signed papers. There were two sets of papers. One was the mod agreement, and the other couple pages was the info on being approved and what not. I believe that the second page is where it said to mail in the paystubs with it. You may want to re-read yours to see if you overlooked that.

    No, it just said to have the paper signed and notarized. Does anyone have the fax numbers for the President or anyone else I can contact? I can't believe they can do this.

    Are you SURE this phone call was from Countrywide? I get a lot of scam calls after I stopped paying...

    I think there was a fax number for the CEO of Countrywide in one of these threads. Fax him a polite letter of outrage. This is not right and I'm sorry it happened to you

    Try NACA for sure, too...

    Unhappy Modification approved, then taken away. CT

    We live in CT and also have Countrywide. We have been talking with them since June of 2008. We had grandchildren move in with there dad, due to a car accident, and other problems. However, we received a approval letter on March 6. Approved on March 22. It reduced our interest rate from 6.75 to 5.75, they added on $10,000 to the principal and our payments would be $1674.00, which they were, but is was going to go up to $2000.
    We were so relieved. We even received a phone call, last week, and I asked the person, everything is all set, right. Right. Our first payment is May 1. correct, answer, correct. no one will be knocking on our door? No. Well, guess what, received phone call 3/29, sorry you will not be getting the modification. I am so upset and angry. The papers had to be notarized to be valid, they were notarized. I can't believe they can do this to people. I am so mad, I even wrote to our Attorney General, as he was one that sued them last year. In one breath they say everything is set, then wait a week and slam you. any advice from anyone would be most appreciated.

    Yes, we received the cover letter and terms. The person that called was from the Home Retention Team. I have been trying to find the fax number. I have also emailed the Attorney General. Our account online, is not showing now. the letter at the bottom says the HOPE TEAM. IF ANYONE CAN FIND THE FAX NUMBERS, I WOULD APPRECIATE IT. I NEED TO STOP THEM FROM DOING THIS. WE WEREN'T PLANNING ON HAVING 3 SMALL KIDS. THEY MOVED IN AND ALL THE BILLS WENT UP. NOW, THE OLDER ONES ARE NOT HERE 24/7.
    I HAVE A LETTER READY TO GO TO THE RETENTION TEAM. ACCORDING TO ALL THE CALCULATORS ONLINE, WE DO QUALIFY. PLUS, MY HUSBAND RECEIVED A SMALL RAISE AND WITH THE NEW TAX LAWS GOING INTO EFFECT, IT GIVES US MORE PER WEEK.
    ANY ASSISTANCE , SUGGESTIONS WOULD BE MOST APPRECIATED.

    double check and triple check all the paperwork they sent you with the mod, make sure your modification paper work does not contain "this modification is subject to wording" like subject to income verification, or investor approval or something like that and did they require you to send back any docs in additon to the mod? like income or paystubs or ask for any upfront funds? If the hope team isn't able to or won't help try the executive team

    So sorry to hear of this but they did it to me also. On 1/20/09 I received a loan mod not a great one, but I could live with it. On 2/4/09 my papers had been signed and notarized, sending upfront funds when I got a phone call from my ln negotiator saying the deal was off the table. My investor (fanniemae wanted me to do a repmt to a mod.) Two weeks go by and they finally refer me to the repmt to mod team. Three days later they refer for another mod saying the rempt was a bad idea, I knew that. My pmt is $3,200 the mod reduced my pmt to $2,475, a no brainer right? So I am now 6 months behind and owe $20,000 could things get any worse!! CW is an animal. They say thwy gave me a mod ion 6/08 not a mod a foreberance added $ to the end and increased my pmt. Who can afford $3,200. I have another mortgage w/HSBC they readily mod my pmt. Until those mod papers are notorized by your investor it is not etched in stone. Most of the wording they all ready have the doc it's a formality. Why did they change they change their minds?? Yes I am trying NACA but had a phone appt on 2/2709 thw woman was suppose to call me back on 4/1/09 nver did but have scheduled another phone via the website. I think if you hire an attorned CW will be forced to honor the mod but who has that cash no me. If they finally foreclose on me I will claim bankrupcy!!! Good luck !~ to all

    I am with all of you I never got the papers for the approval yet but The rep told me we were and our file was with a negoitiator. Needless to say that was a lie 2 days later it was in pre- processing and after that active processing then finally canceled. I did call a lawyer, I filed a complaint with the Federal Comission Trade and The Consumerfor consumer affairs. My lawyer called them on Fri they lied and said they spoke to me and I had them put it back in for a loan mod, They lie so bad they told me I had a debt of 250.00 that i pay monthly on a creit card. I pulled up my report the same time and I told him he was a damn lie I am looking too. He got stiupid and didn't know what to say. I think BOAis behind all this because they took over in July.

    I don't have any suggestions here, but just wanted to offer a little support. We are all acting from such an honest, basic place. We want to stay in our homes and pay a fair, liveable mortgage payment. We do everything we can and find pennies in our budgets to stay current on unaffordable, often fradulent mortgages. To have your modification so close, to experience that relief and have a future in mind again (how many of us can't think more than a few months into the future without getting paralyzed wondering where we will live??) and have that taken away is so AWFUL. I am so sorry you are going through this and hope that you have a positive resolution soon.

    I contacted our Attorney General. I received an email back, stating that they are going to contact Countrywide and find out what is going on. According to the makehomeaffordable site, we do qualify for help. We are paying for than 31% for mortgage, our loan is FHA, and our house is only worth $180,000 , which means we could also qualify for a reduction in principle. One company I spoke with, that has been in business for 15 yrs. said they could possibly get our principle reduced to what the house is worth now, including principle, interest and taxes for around $900 per month. We are paying $1650, and it was going togo to $2000. The CW said we got the mod then took it away. I don't look forward to tomorrow morning.
    After reading all the posts about CW/BOA, I think they have gotten worse.
    They lose paper work, don't return calls, ETC.

    Angry Boa modification. Have 42 hours to send paper work

    We are in foreclosure. have sent modification papers3 times. They are now requesting hardship letter , when it began and ended. Account statements. We have sent this 3 other times. Also, I have another question. I did the home affordable program. Now, what i need to know, when you see if you qualify, does the escrow also count?
    our payment went from 1440 to 2000. I told them this and they said that the escrow amount does not count. another month, we received 3 statements, with 3 different amounts, after if had been modified and then they took it away ...
    I am ready for a heartattack... They are the most difficult people to talk to or you get different answers from each person... please any advice would be helpful.

    Keep a keen eye on that foreclosure sale date and don't get to close to it.

    Chapter 13 may be the only way to save the house.
