    Been making payments, but got Citi letter stating forclosure

    Totally blindsided here with a letter from CitiMortgage stating that I'm almost $7000 behind with my mortgage. I'm about two months away from wrapping up my 60 month Chapter 13 BK. I've been making $1500 per month, electronic payments on time when only $1440 was due. Have no clue what is going on here. They even when to the BK court and got a relief of stay, so they can proceed with forclosure. I had not recieved any correspondence from them until I got a letter stating that my house is in forclosure and that I need to contact their lawyers.

    2-3 years ago, I had been after them for a modification, with no luck whatsoever. All I want is a 30 year, 3.5% loan. Might even consider a 15-20 year loan, but would prefer to have the time. Do have a 2nd with CitiFinancial that was considered "Voluntary Payment" that I did up until a couple of years ago until I just couldn't afford to do.

    Have heard that Citi has had some issues with tracking payments recieved and wonder if this is what has happened to me?

    If your payments are not being applied properly per the court orders through the bk, you may want to contact your attorney and ask them what you would need to do to get that corrected. Unfortunately with the modification you would not be able to pick what you want it to be. Have you been denied a HAMP modification and if so, what was the reason?

    I pulled a report from my Wells Fargo electronic bill paying, and for the past 5 years. The report confirms that what I have submitted is over and above what was due. BUT, there were several large payments, which I don't ever remember doing. Almost as if the bank waited and sent them to CitiMortgage bunched up with 2-3+ at a time. Very strange. Almost like there was an issue as to where they were to be recieved.

    I have sent all the requested info into them, but yet have not heard a word. Not getting any help from my BK13 lawyer either.

    Update 8/14/2012: Things appear to be going fairly smooth with my modification. Should be getting the paperwork for the 3 month trial period very soon. Anxious to see the details and wonder if the terms are the same with the final version. Payment went down about $175 per month, and I'm fine with that.

    Personally, I'm very pleased with the way things are going finally. Not sure what the difference was/is in what I'm doing differently. Am getting too old for all this added stress and just want it over. I'm gonna set up automatic payments so nothing like this happens again. Anyone know if Citi has actual banks in Colorado? Figure I better try to find one so I cut out any steps.
