    Wayne County Michigan Foreclosure questions

    Hello.

    I am currently trying, in vain, to do a loan mod with lender. I will save you a long boring story by saying I do not feel it is going to happen. Incompetence and delay on their end, mostly incompetence. I am investigating all angles now. Let's face it, banks most certainly cover their backsides so I am now looking to cover mine.

    I understand that Michigan has a 6 month redemption period. then, whether it is the bank who bought it or a private citizen, they have to petition the court to get an eviction date. So, in Michigan, there is the "potential" to stay 6 months and maybe an extra week or 2 after sheriff's sale.

    My question is this. Wayne County Michigan being one of the top foreclosure hotspots in the country, does anyone know how long it takes a lender to get a sheriff sale date in Wayne County Michigan? I am tracking several properties on Realty Trac right now (not sure how often it's updated) but thus far it looks to be AT LEAST a month. I called 3 "foreclosure prevention" places and they all said 3-4 months...if not longer as there has been a recent spike in foreclosure activity. Interesting!

    If what I believe to be the inevitable happens I plan on starting on thread so any other Wayne County Michigan folks who may be in dire straits may learn from my experience.

    When non judicial foreclosure is filed a workout notice is offered. If accepted then a 90 delay is put on the foreclosure. After that expires a sheriff sale date is set. My own foreclosure was filed in early Dec 2011, I did not accept the 90 workout and a sale date was set in Jan for early Feb 2012. I follow foreclosures in Wayne Co and I am seeing some judicial foreclosures being filed instead of non judicial which is new since May 1, 2012. Some other sites to use are foreclosure .com and legalnews .com. In my research I do not see any delays in filings of the sale dates.

    Thank you for the reply. New to this. so non judicial is the sheriff sale process, yes? How does the judicial process work? Thanks

    Sorry, hit post too soon...I am currently in workout mode...so that is considered non judicial?

    Workout is offered by state law to all foreclosures. The judicial filings are new it seems just since May 1st. Have you had a Notice of Default filed yet? Judicial means they are filing a lawsuit and have to take you to court to get awarded the judgement.
    Non judicial is foreclosure by advertisement and they would file a notice of default and then publish the notices for 4 weeks in the newspaper and hold a sheriff sale.

    Intent to vacate/walking - how to communicate re: HO insurance?

    Chap 7 non reaffirmed. Nasty grams up the wazoo, but no official action taken as of yet and it has been awhile. Finally walking and moving on. I do not want to be on the hook for insurance once we move. I was going to call and send a letter stating from date X I am cutting off Home Owners insurance. What is the best way to handle this? Thank you in advance!

    State of Michigan - Walking - water bill

    Walker from State of Michigan. Not intended, but missed last 2 water bills as city sends this smurf sized post card in the mail for a water bill and being a 3 month bill, who really pays attention? Anyway, behind, was considering paying but last bill stated overdue balances are dealt with by placing a lien on property. I understand what that means, but as it is a "utility" can mortgage servicer come after me for balance and the obvious "grab ankles" fees they will impose? Is it different from say unpaid property taxes which are locked to the property and the individual? Thanks in advance.

    One of the members replying here in one of your original threads about the walk has already been through foreclosure a year ago, you may want to post these questions in the following thread since the process was completed in the state of Michigan.
