Huge problem! Help Me PLEASE!!

This is the sad story.
I am in the process of a very horrible divorce. My ex abandoned the family and liquidated all the retirement accounts. As I fought in court (trial was postponed to Oct 5), he denied me access to the mortgage accounts. I am on the deed of the property but I am not on the loan. We bought the house in 1993 then refi'd for 15 years later. The court gave me authorization to access to the mortgage. For many months I was just throwing money at the account. My payment is $1340 but I would pay $2000 or $3000 because I didn't know if it was behind. After fighting with citibank for the month of March about my letter of authorization. They finally granted me access to the account. By then the account was approx $7000 behind. I wanted to make the payment to bring the account current but they told me that they would have to order the exact amount for me to pay and to call back in three days. This went on for over a month. I would call, and call, and call. Each time, they told me it had been ordered and I needed to call back. By May, I was hysterical. They wouldn't let me make any payments. Finally, someone suggested I pre-qualify for the HAM. I pre-qualified, made the first payment and waited for my packet. June 1 I called and made my second payment. I told them I hadn't received a packet. June 18 I received the packet and started working on it. All of a sudden, I got a piece of paper on my house stating that the house was for sale on July 27. When I called, they told me that the sale had been postponed until Aug 27. I mailed the packet on July 6 (wasn't due until the 8th). They received the packet, payment,etc. I called everyday to see if they need anything. Yesterday, I called and they asked me to resend my 2008 tax returns because I forgot to sign them. I'm fedexing them today.

I am very concerned for several reasons. One, the sale is only a month away now. They told me to call Monday and ask for a postponement but what if they don't grant it!? It's flipping me out. Second, the loan is not in my name. My ex has already let one of our houses go in this divorce. Not because he didn't have the money to pay, but because he refused to use the money to pay it. The same thing could happen to this house. Also, I still have the $7000 to bring the account current but I'm afraid of attorney's fees and property taxes. Attorney's fees make me angry because citi wasted so much time initially when I wanted the reinstatement amount. I could have avoided them altogether.

1. Do you think the postponment of the sale date will be a problem considering my level of coopertation?
2. Will they work with me if I am on the deed and not the mortgage? They have so far. They should have told me no originally and given me the reinstatement amount way back when.
3. Will reinstatement be an option for me for the deliquient amount of $7K?

BTW, I should add that I only have eight years left on this loan and my house is paid off. It does have a second mortgage but I am current on the second.

I would call the Exec Response unit number 1-866-255-3901 and tell them you got it from loan safe. It sounds like your dealing with different people and each time your getting different information. The modification process is supposed to stop the sale date but you want to make sure that that is really what they did. At least with the Exec Response unit you will be dealing with one person and their response time is pretty quick. I found them to be very upfront about a lot of things, at least for me.

Apparently, it just postpones the sale date. My new sale date in Sept 28, 2009. I've scraped the money together to reinstate but I'm worried about outrageous attorney's fees, late fees, etc. You always have to have a plan B.

Usualy if they make a MOD they add all fee's and late payments to the balance of the loan and start you on a new payment plan..

I know but they I don't think they are going to modify it now. I'm worried about the reinstatement amount.
