Lost as to what our options are -forclosure

My husband committed a crime against my daughter and is no longer allowed in the home. Because of this, our household income dropped. I was already in fragile health and I guess the stress from the situation aggravated it and I ended up losing my job due to health problems. Once my savings ran out, I couldn't keep up with the mortgage payments any longer. My long term disability is supposed to be starting any time, but it hasn't yet. When it does, I will once again be able to afford the house payments but until then, we are in a real delimma. My household income at this time is barely more than the mortgage payment.

Citi has a foreclosure sale date scheduled for our house August 6, 2009. I have tried and tried to get some type of modification since last year. I have already filled out two Workable Solutions packages and they just told me to fill out another. Originally, they assigned our loss mitigation to a law firm called Millsap and Singer. They (Millsap and Singer) sent us a letter saying to call them in 7 days, so we tried several times a day every day but all we could ever get was a machine that said to leave a message and they would call back in 24 hours, but they never did. They only way you could apparently talk to a person was if your sale was scheduled for that day, but if you pushed the button to go there and your sale was not for that day, they put you back in the answering maching queue. I even called Citi and the reps would try to call this place but they could only get the machine too. This has gone on for about 3 months.

Well, Millsap and Singer changed our house from loss mitigation to foreclosure due to "lack of contact" from us, even though we were doing everything we could to try to get a hold of them.

Now, I am on the phone with Citi a lot and had to do another workable solutions package. I filled it all out and faxed the info off. We have an FHA loan at 7% interest and owe $110,000 on the house.

Does anyone know if we even have hope at any kind of a modification? I was already sick before and now this is taking its toll as well. If there is no hope, I wish they would just tell me and get it overwith. I feel like I have been jumping through hoops for months now and it seems really unfair that they would play with people like this.

It is going to be a little more difficult since you do not have proof of income just yet. Explain all this in your hardship and also how you will be recieving lond term disability shortly. Try faxing to these numbers and also call as well. These 2 have helped many here in the forum get their mod started in a timely and professional matter:

Is child support an option, how old is your daughter,......even if your husband has been ordered to stay away from the home, if the child is a minor, he is still obligated to support her.....a stay away order is not a valid defense to a child support action.......any such amount should help with your income situation. Hang in there......this is a lot to deal with....Take care and God Bless.

She is my daughter, not his, so child support from him is not really an option. He is getting ready to deploy again though and his commander said I will be entitled to his housing allowance when he goes on active duty orders. That will be more than enough to pay our house payment. Also hoping since we will get medical coverage, I can get to see a doctor as much as I need to and get better so I can start working again before the deployment is over.

Well, after being told we would be eligible for a loan mod and that they would put off the foreclosure sale that is scheduled for Aug. 6, we found out today that they are now not going to give us a mod and the sale is scheduled as originally planned.

They gave us some numbers they say we HAVE to call and no one else can give us info, but no one answers. They also said we have to contact Millsap and Singer again because they are also in charge of our foreclosure (were in charge of our loan mod too!) The problem is, they do NOT answer their phone. You can only leave a message and wait for their call.

Now when I had problems with M&S before, a manager from Citi said they were a company subcontracted to help with the overload but they should not be avoiding customers like that, but Citi is not helping us contact them.

Our situation that led to our falling behind is a bit unusual and involves several different criteria that should have gotten us some modification or forebearance or something but we were not helped in any way. This has been going on for months.

I called my US senator who was very much against all these bailouts and their office is interested in hearing more. I don't think we can save our house, but even though I am sick, I don't plan on letting them have it without a fight.

Anyone have any more suggestions about what we can do now?
