Mortgage Co cant find our original mortgage - Loan Modification Forum

This morning we were served with I guess an intention to foreclose on our property. In reading the paperwork Citi Residental who took the loan from Argent - and then passed it on to American Home Mortgage Servicing, as requested from the judge to say we have a mortgage through them, and they specifically state they can not find the paper work.

Has anyone had this happen?

I'm not exactly sure on this one, but I would think Argent would since they are your original mortgage company...

If they cannot find the note, then, they cannot prove they have the legal right to foreclose......"produce the note" has been used by several homeowners to stall the foreclosure process.

Well hurry up and apply to NACA save your home and add the close date they may be able to help
