Citi Mortgage transfer my Loan to Bayview Loan Servicing

I'v been working with Citi mortgage on my modification back in Feb 09, finally got some answer on Jun 07 saying that I'm not qualify because of my income. When I bought the house my income was $8k/month now is less than 1/2 but with my rental (room for share) it came out around $4500. I don't have any credit card debt, beside my car payment. I bought my house at $625K my loan is $500K. Now there is a house in my complex listed for $299K. Citi mortgage told me that they can't help me with that so they denied my loan due to income and i'm 4 months behind. And on Friday I got a letter from Citi Mtg saying effective Jul 01 my new loan Servicing will be with Bayview Loan Servicing. I called Citi they said they will not deal with me anymore. I have to call Bayview loan Servicing? What is that mean? Does that mean I have to redo all the modification with the new loan servicing? I'm so lost, worry and scare don't know what to do. Please help me, please tell me about Bayview Servicing do they have a hard to help people. I'm so scare of losing my house...I want to save it if I can...Please advice...

If you were denied a modification from Citi you would need to see what the options would be and go through Bayview for that at this time...........

I am just wondering what happened? Were you able to work something out with Bayview? I had almost the same thing happen to me. I was with citi and then all of the sudden I get a letter from Bayview saying I owe them like $5000. I had been making my payments to Citimortgage and they had been cashing them but somehow not forwarding the information to Bayview. I finally got all of that worked out and was current but then today I get a notice that Citimortgage had filed a notice of foreclosure. They weren't even mailing the letters to the right address. They were mailing them to my old office address and luckily I stopped by there yesterday by chance and got the letters. Anyways, I call Bayview today and they try telling me that I am past due since July 1st. This is not true, I do owe for September and October. The gentleman I talked to was very nice and said he would call me back tomorrow he was going to try to work somethings out. I am very hopeful but after reading many of the post on here I am beginning to be worried.

I note the transfer to Bayview on this old thread occurred about the same time my Citi was transferred to Hardwick.... an Atlanta law firm. Citi was apparently outsourcing to many firms since they didn't have the staff.

But while Hardwick kept telling me to be patient they had all my info (I had sent to Citi) I got a foreclosure notice in July which should not have happened. Was even told I was approved as of 5/1 which was the first day Citi started approving HAMP's

Frantically called back Hardwick (not sure if name correct without looking up) and they said all transferred back to Citi which immediately ...again.. put me on the HAMP trial... the one I thought I Was patiently waiting for a processor to call me about from May 1st.

In your case it looks like never went back to Citi like mine did after its brief stop at the outsourced law firm. Do you have a foreclosure sale date?

If you were foreclosed on when you shouldn't have been you may be able to get it reversed and not charged the attorneys fees etc. I am working on trying to get that done but I'm back direct with Citi.

Am also waiting for a return call for lawyer to me sure their current no sales date foreclosure hold means what the mangers team told me it does. No sales date and have to restart the notification process of 90 days in AZ if they took the hold off. But this is the key point I want to confirm with a lawyer.

January 10th I believe is the sale date. I really really hope I don't have to get an attorney. The gentlemen was very nice so I am really hoping he was not not pulling my chain. Even with the information they have, that I am deliquent for August, September, and now October that is to soon to file a notice. I was pretty positive it had to be 90 days. I wish someone on here was currently working with Bayview.

But I am paid up through August and have the cashed checks to prove it. I told him I could make September and Octobers payment today but he told me to wait until tomorrow.

You have some time before 1/10/10. If all else fails you can cure up to the day before the sale date. I don't recall if you said who your investor is. If Fannie it MAY be good either if you qualify under HAMP or Fannies other options.

When you say thru Citi I assume they are the servicer not the investor. Unless Bayview is the servicer for a Citi Mortgage which doesn't make much sense but could be.

And if Citi filed the foreclosure they must be the servicer, but surprised Bayview still is servicing for Citi? IN my case Hardwick was servicing for Citi and Citi filed the foreclosure with no communications with Hardwick to know how active I was trying to get processed under HAMP

The notice period in AZ is 90 days before the sale date, but they can serve a notice to foreclose even if only one payment behind.
