Foreclosure on the Horizon!

I've been working with NACA to do a loan mod with Chase Home Finance. NACA sent it to Chase on February 6. As of last Thursday Chase says they don't have it. I've since had a foreclosure notice taped to my door with an auction date of March 18.

I called the CEO's office at Chase and talked to someone on the executive resolution team. He told me that once they receive the mod, the foreclosure proceedings will be halted until it is reviewed.

I have left messages for NACA, emailed them, sent messages pver their web site and faxed them to tell them Chase hasn't received it but I have received no response. I don't know what else to do. Now, when I call I am member 60+ in line. It's dreadful.

I am considering filing Chapter 13 for other debt, but I understand that now that I have received a foreclosure notice, Chase can ask the judge to lift the automatic stay so they can proceed with the sale! I can't believe this!

If anyone has any ideas what I can do now, please comment. I am so worried.

I am SO sorry to hear about your situation.. I know how it feels because I'm in a similar situation with Option One/AHMSI with Wells Fargo as the trustee. I have a judicial hearing March 30th, and my attorney (whose practice is in bankruptcy law) has told me I don't have a legal defense to the plaintiff's complaint as I have not made payments for quite some time (how could I, when they set the payments up to be almost 100% of my take home pay??).

I fear that the judge will rule for the plaintiff and order my house sold. Needless to say, I've been having a lot of sleepless nights and doing a lot of crying and praying. To make matters worse, I recently lost my job and realistically, I probably won't find anything anytime soon--certainly not a position that pays more than my old one did. I won't have any place to go if I'm forced out of my house and it's a terrifying thought.

As for NACA, did you click on the Home Save link and scroll down to Auction/Sale? It says there that they will prioritize your case. Also, on that page, there's a link to a feedback/complaint form if you haven't gotten any responses in a timely manner. Hopefully I will hear from them next week. Again, I am sooo sorry about your situation and will pray for you and everyone else here in a simllar situation. God bless!

Hi Sally - I sympathize. I really do. It's dreadful!

Re your last paragraph, yes, I did both of those things.

Monday, I am contacting the White House! Chase agreed to a foreclosure moratorium on Feb 12. I had a foreclosure notice taped to my door on Feb 14.

NACA sent my loan mod to them Feb 6. Chase says they never received it, but they have told many, many homeowners the same thing. Foreclosure notices can stop us seeking protection and saving our homes under Chapter 13 bankruptcy. They KNOW what they are doing.

I am also considering setting up my own blog (free at blogspot.com) so people can track my story. It will also give me one link to give to the White House so they can see my full story. I hope other homeowners do the same thing.

Putting up a blog is a GREAT idea! I think I will do the same thing. I already have a Blogspot account. I think what we all ought to do is do the same thing, and link them all together for everyone out there on the Web to see.

Another suggestion: President Obama has a MySpace page and he is in my Friends list. I don't know how often he logs in or what, but I am gonna send him an email through there and tell him about my situation. At this point, we have nothing to lose by doing anything and everything possible to draw attention to our plight and get some REAL help.

I did send him a copy of my documentary short film, "Predator" on CD and sent copies of that letter to key members of Congress (Ms. Pelosi, Harry Reid, Steny Hoyer, etc.) I told them all in the letter that my situation was a major factor in the organ transplant team's decision not to take one of my kidneys and give it to an Iraq war veteran on the waiting list at Walter Reed Army Medical Center.

I am NOT giving up on this veteran (who's a young man), but if I'm forced out of my house with no place to go, there's no way I can return to Washington to give him his health and future back--and he could very well get sicker and die sometime down the road, the thought of which just breaks my heart!

I'll be glad to give you the link to President Obama's MySpace page tomorrow (it's almost 10PM here and I'm feeling stressed and tired, plus my asthma is rearing its ugly head because my !&$*^)!! doctor turned me away because I don't have health insurance and no money to pay for an office visit upfront... ARRRGGH). We just cannot give up fighting for our homes and letting those SOBs win.. we just cannot! And in the meantime we have to do a lot of praying.....

P.S. You said Chase agreed to a moratorium on foreclosures.. how long was it supposed to be for? How could do they do that to you, agree to the moratorium and then turn around and have a foreclosure notice taped to your door?? That's so underhanded. Do you have a lawyer representing you? I've lost faith in mine. I don't feel like he's doing enough to help, or maybe that's as far as he can go, I don't know. I do know I want one with real BITE who would be willing to file suit for predatory lending--but so far they're not out there :-(

NACA apparently has a section on their site for those who have received notices of forclosure. I would contact them and let them know you received the notice, it fast tracks things.

I did that already. I left a phone message, faxed them, emailed them, sent communication over their web site - four days ago - but I have received no response.

It seems once they submit your mod, they are done.

All I can say is keep contacting them. Keep trying...they are swamped, especially at the end of the week.
