The loan is in my husband's name, I have nothing to do with it. (Just FYI.. my husband and I are separated, however my kids live with him and some of my stuff is there until I get into a permenant residence and were still great friends) I agreed to help him with this loan mod. It is just a little more than he can handle at the moment. My husband return his call, and basically there was a couple items still needed info on, and he asked if he could make a payment of half of the trial payment within 20 days. My husband agreed. However, my husband didnt realize that he didnt have all the funds. So I told him he is going to have to call Chase back and explain that he committed when he cant follow through. He asked me if I could do it. I called the contact at Chase and of course he wouldnt go into details with me, but made sure he mentioned that the call was going to be recorded for collection purposes. So I asked him as a general question "can he change his commitment". He said yes, the paperwork has not been submitted. I said ok, I will have him call you. Right before we hang up, he asked... are you employed? I said yes I am. I'll need to talk to your husband about your income. WTF.. they cant go off my income right? I have nothing to do with it. Please give advise. |

They used his income. if you do not want your income included, you may have to show proof of a legal separation and proof of a different residence. If they think you have a lot more income than is reported, that could jeopardize your mod application. |

It's probably best for the success of the loan mod if you support him from behind and let him solely communicate with Chase. You don't want them to think that you two are still together and can actually afford the mortgage. They can consider your income if your husband chooses to submit the docs but Chase can not enforce you to become part of the income source. |

I am not employed and was using my husbands income ( he is not on the loan) and I was told yesterday that they will not use his income they want me working or no modification and I would never get past the trial period. I found this: The guidelines for servicers participating in the Home Affordable Modification Program state: “Servicers should include non-borrower household income in monthly gross income if it is voluntarily provided by the borrower and if there is documentary evidence that the income has been, and reasonably can continue to be, relied upon to support the mortgage payment. All non-borrower household income included in monthly gross income must be documented and verified by the servicer using the same standards for verifying a borrower’s income.” |

If you can prove you live somewhere else (utility bill for instance) and your name is not on the loan they shouldn't be using your income unless you want them to. You really should be letting him deal with this when it comes to talking on the phone. If you want to help him to get his paperwork together, etc., that's alot of work anyway and alot of help.

NorCa, I was just approved for a mod and am unemployed, but my spouse works and is not on the loan. his name is on the home though. You should keep calling Chase till someone works with you. |
