Trial Mod Question

I received the trial mod package and faxed and fedex back to chase. Do I have to get a signed copy from them? If so, how do I request one? Who do I contact?

I just want to have all ends covered.

Re: Trial Mod Question

They are "supposed to" sign and send you back a copy within 30 days. But don't hold your breath. You may die first.

Re: Trial Mod Question

Yep, I agree. Dont count on getting it back. I have filed complaints about it over a period of months and I understand there is some knew directives (Fannie/Freddie)out that give them permission not to have to provide it.

Re: Trial Mod Question

Yep back,
I was actually surprised to get the Trial Document after 3 payments since there is a directive saying its no longer needed....

It use to be you weren't officially on a Mod till both had signed the agreement that often was never sent by the servicer.

Re: Trial Mod Question

We sent them a qualified written request a month ago, demanding that signed agreement. we didn't get it (although they promised to send it out several times over the phone). Since it's no longer required, what the he**..

They said all they needed was OUR signature and they got that. They also said they would return that agreement along the docs for the permanent mod..

The lender is not going to send you a copy. You should have made yourself a copy to protect yourself. You have to treat the lender as the enemy and arm yourself for your own safety. They do not want to do these mods, they are being forced to. They want you to screw it up because you only get one chance at the HAMP. Never return anything to the lender without making copies for yourself.

We certainly made copies - my concern was that they didn't return a trial plan with THEIR signature. The agreement said it wouldn't go into effect until BOTH signed it and the borrower got a signed copy.

But they changed that now..

Re: Trial Mod Question

They changed that, but wouldn't that just be for trial agreements going forward? If the agreement they already sent you says it is not valid without their signature, then that's a technicality they can use in their favor.

Correct. That's why I wasn't satisfied with their reply and send them the qualified written request.
