Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Quicken Loans shorted my monthly escrow on a primary residence (fixed rate 30 year loan) I purchased in August 08 (I believe it was on purpose either to lower the payment so my loan would clear my income, or maybe to force a default so they can collect on their PMI or credit default swap) I didn't learn this until Chase took over servicing & sent the annual escrow disclosure. It showed that the escrow was negative by about $2,800 and they demanded I pay an extra $6,000+ into escrow, and adjust the monthly payment up by about $400 mo, OR I could pay an extra $941 a month for the next year, then pay the higher payment (by $400). I called Chase & they said "oh your property taxes must have increased". I told them the prop tax had actually DECREASED & had just received a lower assessment. They said they would re-do the escrow disclosure & I would get a new one in a couple of weeks. That was mid July. When I received nothing I mailed (certified return receipt) a "nice" QWR to both Quicken & Chase just asking for a resolution, got the green card back from both, heard nothing within the 20/60 days from Chase, got a phone call from Quicken saying they might be willing to refi to lower the payment (no "sorry we screwed up your loan & life"). So I then sent a much stronger & more detailed QWR to both parties. Got both green cards & this time an acknowledgement from Chase; got the original envelope back from Quicken which had been opened & sealed with scotch tape. I kept it as evidence & printed out another copy & resent; still waiting to hear from them. Since Chase is demanding I pay the extra $941 monthly, I have stopped paying as of a month ago & just got a statement for Nov with a late charge. Any advice on where to go from here? Isn't this mortgage fraud & payment shock of the worst kind (intentional)? |

Send an immediate complaint to the attorney general of your state (where are you?) 2. Send an immediate complaint to the Better Business bureau. 3. Send copies of the complaints to Chase and to Quicken. 4. Call the Chase executive Team and let them know you are filing complaints. 5. Send copies of the complaints to your senators and congressmen. Then if you have the money, hire an attorney. If not, see what these things do. Somebody out there might have much better advice. this is just what I'm thinking right now because you have been screwed with (pardon me). It started with Quicken,and was perpetuated with neither Chase nor Quicken responding to your initial QWR. My 20 days is up on my QWR with Chase next week, and you'd better believe they will be hearing from me if I don't get anything. this has got to stop. |
