My wife has not worked due to 2 of the children being special needs. I have been working as a union HVAC installer in new houses for over 17 years. Worked non-stop in the cold winters and hot summers up until 3 years ago. I was laid-off along with many others. The unemployment at my union hall is over 25% right now. Many of the people working are only working part-time and I have been unable to secure any employment from them. They will not even allow me to be on the out of work list and go back to work! Right now my wife and I are getting about $2,100 a month in income, most of it from child support from her ex-husband to support her 4 children. The rest of the income is from me doing odd handyman jobs on houses and fixing cars. We do not have many expenses. A few hundred on a couple charge cards, but we are not paying them, so those are not expenses at this time. I started a loan modification last year before the government announced it's big help plan. Took 4 or 5 months, but I did get a modification. They lowered my interest from 5 7/8 to 5 3/8 and that was it. It lowered my payment from $1875 to $1805. Woopdidoo, big savings there. This did not help us at all. Our first payment for the new terms was in May. We have only made that one payment and no more since, so I am 5 or 6 months behind. At first Chase refused to work with me on a new modification because I already got one. HUD and HOPE told me Chase was wrong and they could not refuse to look at a MOD, so I worked with a HOPE counselor to get a new modification started and had it sent to them by the middle of May. I have been waiting for the answer since then. After repeatedly being told it was not ready, two weeks ago I was told my modification was not even being processed!!! They admitted receiving my MOD paperwork with my hardship letter, but told me they were running 4 to 5 months behind. They also told me they needed new current information that was no less than 60 days old......Ok, how is this going to work if they are 4 or 5 months behind schedule??? One person I contacted told me I was $600-$700 short for them to do a loan mod. The HOPE counselor and I did not come up as short as they did. If they would drop the interest rate to 2 or 3% and extend the loan to 40 years like I have seen them do for others we certainly have the money to do that from my figures (Can anyone confirm the numbers for me?) On another phone call the person on the phone told me "We can do this over the phone right now, just give me your current financial information." I told them It took me many hours to prepare the original modification and I was not going to cut corners and give them inaccurate information over the phone. This was WAY to important to my family and I to take a risk of not crossing all of my T's and dotting all of my I's. I received a letter in the regular mail from a lawyer last week. It am not sure the purpose of the letter, but it basically listed 8 items like this... You are hereby notified: 1. this is an attempt to collect a debt..... 2. At this time, no attorney with this office has reviewed the info.... 3. This office is a debt collector... 4. Chase Home Finance LLC is the creditor... 5. As of this date you owe $215,000 odd dollars 6. Unless you, within 30 days dispute the validity the debt is considered valid... 7. If you notify us of a dispute about this debt within 30 days.... 8. If the creditor listed is not the original creditor notify us in 30 days and we will furnish the info to you. That is it. Chase is telling me my loan is marked as under foreclosure and I am not in line to get any assistance or modifications at this time even know I sent them the info on May 18th and they even acknowledge that. I thought I had saved copies of the documents I sent them May 18th on my computer, but I did not...MY BAD! Right now I am scrambling to try and get Chase to send me copies of the original MOD paperwork I sent them on May 18th of this year, so I have something to compare and work off of for the new modification information they need. I called the standard number 800-848-9380, which is the only one I have, and they insisted I must call a different number (the loan mitigation department I guess) They told me I needed to contact the other department as they did not have access to the paperwork I sent. I then called the other number again and again, and I was told they could not send me the information. After repeated phone calls and speaking with a supervisor I was finally given FAX number to request the information in writing. I have faxed them a request a few times and still nothing. The fax I was given was 614-422-7575, but I do not know if anyone got it and if it is being processed or what. I wish I was able to contact someone and ask them "Did you get my fax? and, "How long will it take to fax me the information?" Does anyone have any suggestions for us on how to get this paperwork and maybe how to proceed? We would really appreciate the help. Thank you. |

If you cannot get an attorney, then I would suggest getting an appointment with NACA right away. They are behind as well and not quite as effective as they would have you believe, but they might be able to get something worked out or at least should be able to stall Chase from actually selling the house. Essentially they will take over working with Chase for you...from what I have gathered from others you will have to keep on NACA about status updates, etc, but it may help in the long run if Chase will no longer even speak to you about a mod. What you received was essentially a notice of default which is pretty standard. I would start checking out the foreclosure laws in your state so that you know what you can expect, and especially to see how long you will have if they send you a certified notice of sale with a sale date. Generally NACA can stall those as well to either give you more time to get something worked out, or to save more for moving expenses should you ultimately decide to stop paying on the house move. Are you in a judicial foreclosure state? If you are and Chase is not the actual investor of your mortgage note, then you might be able to further stall the process by filing a motion demanding them to find and show the original loan note...not the copy, the original in some states. Check your laws because again, it is different from state to state. Unfortunately, what you are getting from Chase right now is not terribly uncommon. They are horrible to deal with. Our experience thus far has been nothing but an abundance of ignorace, apathy and BS from them. I sincerely hope that your situation ultimately turns out better, and that you will keep us posted on how things are going. Good luck!

I doubt that it is likely that Chase will be able to locate and fax your paperwork back to you from May. The letter you referred to from Chase is a basic collections letter - they are a debt collector - they are letting you know that you are past due and they want their money - I believe your best course of action as of now is to call Chase until you talk to someone who can/willing to work with you and the pending foreclosure. You will need to get all the paperwork you did in May together again - make sure it's up to date and complete - Do not expect Chase to send anything back to you other than a demand for payment - I mean no disrespect - The best you can do now is be as persistant as possible - do not take no for an answer - exhaust every avenue - if you have legal aid in your community - make a call and see if you can get some free advice from them - |

Together maybe we can make a stand! Just like the labor unions have helped the working class. I do not think I can afford an attorney, so the NACA place mentioned sounds like the avenue for us. I had not heard of the NACA before. I am surprised I did not see it after all the threads and posts I have been reading on this forum since I found it the other day. I went to their website and watched the news coverage links on the site and started crying. Sorry I am very emotional about this stuff. Seeing someone out there sticking up for all the people who need it is very inspirational! What do you mean by the "Office of the President"? I assume you are not talking about Obama? Sorry to hear you have been lied to, but keep reading here and it's a common occurance. I'm on my own journey with Chase, but I have decided to not pay them. We shall see if they have the nads to foreclose. I would not pay a red cent and would start SAVING your money for your family and the possible move. At worse, you have an emergency fund ....which we should ALL have regardless. Once you go a few months without feeding the usury monster, Chase will contact you for sure to try and do a loan workout. They really really really don't want to have to foreclose on the home because they don't want to claim the loss. Makes the books look bad you know....gotta cook them books, its the American way. It will take them awhile to actually proceed with foreclosure. If you get an NOD, then you know they are getting serious. The NOD will come registered mail AND regular mail. You can then just wait and see if they proceed with a set date for auction. When you receive that date, you take the money you have been saving, and hire an attorney to file a bankruptcy....chapter 13...chapter 7...doesn't matter, you can change the filing, it's just important to put that stop on. The BK will put an immediate HALT to the auction date. By law, Chase will now have to deal with YOUR personal bankruptcy....oh it's starting to get good now. When all this shakes down, you will have stayed in that place for at least 8-10 months, Chase will be having to explain why yet another mortgage is producing ZERO capital, while the taxes and HOA fees just keep piling up. Personally, I hope the system collapses. It's broken, run by fraud, and is no different than organized crime, except THIS fraud is protected by the military might of the United States, and the rule of law (is there any wonder why many people have little to no respect for our laws?). Hey, with the way this country works, we should just declare a WAR. War on Drugs....War on Poverty...War on Mortgages. If the past "wars" are any indication, I look forward to the system becoming even more crony and corrupt. Save the children, back the WAR ON MORTGAGES!!!! |

One word of caution: if you choose NACA, Chase Exec Team won't work wiht you because they have a specific NACA/Chase team. That said, NACA can often work quickly in situations like yours and i would call them. Call Kevin Winn. 617-250-6222 Extension 1254. You will have to leave him a message. Tell him you are not with NACA now but want to sign up because you believe foreclosure is imminent. He has a really good track record of getting back to people. You will have to sign up on their site, yadayada, but call him.
