Sale Date was set for 11/3/09

but I was able to get trail mod two days after receiving the letter from the attorneys.

When I first found out there was a listing in the legal section of my newspaper but it is now gone. I have contacted chases attorney they said it was cancelled. I called chase they told me it was put on hold. Is there anywhere else I can check if all this information is true. I am not trying to be negative but I just don't want my home sold on Tuesday. I have heard some horror stories on here about banks selling homes while the homeowner was on a trail mod. I also live in GA which makes it even worse.

Also the trial mod is on the MHA plan
Any input would be great

look at the website. you should see a complete history of what went on and whats goin on now. If the sale date was canceled, you shoudl see that there also. I live in the Phoenix area and all that info is public and listed there. I understand not all counties are up with the times. Obviously you have a computer, so I would start googling info. Try your address for starters, then go from there, there may be some public listing elsewhere such as a newspaper's website. There may be quite a few newspaper publications in your area. Don't assume its in "the paper" knowledge is key, and will help you make a decision for you and your family. It is quite possible that your county has no website. In the end though never assume anything untill you see it for yourself.

I live in a very small county and I was told they only listed in the counties newspaper. I went and brought every newspaper this morning and my property is not listed. They don't have a website that list foreclosure so that's way i was worried a bit. I am about to call Chase again to see what they say.

I wouldn't believe Chase....period.

There have been stories here where people were told the auction date was stopped.....and a few days later someone was coming by with the sheriff to evict them. Talk about stress!!! It took the people some fast action with an attorney to even stay in the house past the three days.

When MY auction date is set, I'll already have an attorney poised to declare and submit my BK...1 day before sale.

For the Chase readers to this site....your company is going to pay a lot more money to get me out than most of the sheeple you deal with. My garage sale will be remembered by many in the neighborhood. I already have people ready to buy some of my upgrades at rock bottom prices. Oh, I'll stay within the law, but there are very cheap fixtures available.

Oh did I mention, the AC unit is no longer working, and I've already started that remodel....need to make sure Chase doesn't get anything other than what was in the house when I bought it

Okay people... I called chase's attorney and I called three diffrent people at chase and I was told the same thing Maam your sell date has been cancelled pending your MHA plan review. I just have to pray now. I ran out of number to call so I am going to have to believe them for once.

I wouldn't believe Chase on anything EXCEPT - in Georgia, they can't cry your sale at the courthouse if it hasn't run in the local paper for 4 consecutive weeks. It is supposed to be paper with the greatest readership in your county. That's how our sale got postponed from Sept. 1 to Oct. 6 - they didn't get their ad in the paper in time for September.

What county are you in?

I am in Rockdale county and I did check the Rockdale Citizen which is where they would post it. And it was not there but when I first got the notice it was there for one week. After I got the Mod trial I checked and it was not there i have been checking every week. The newspaper comes out ever thursday and i was not in this thursday paper. Right now I am not going to worry about I am just going to have faith.

But in Bankrupcy they can lift the stay on the foreclouse in like 30 days so only delays.

Chap 13 does put the past payments into the plan but you have to keep current on full future payments. Chap 7 no help at all.

True enough, the BK is my last card I have in my hand. After that all my cards are played, and the poker game is over.

If the BK 13 can force Chase to come to the table and simply COMPLETE what they told me about my final modification, then EXCELLENT, I can strip the 2nd, consolidate all unsecured debt, and get to re-building my life where I will no longer use any banking institutions other than my credit union.

If the chapter 7 only delays by 30 days, at least I'll know exactly when to vacate the premises.

Then again, it's always possible when no one BUYS your home at auction date, you can live in your home for many more months.
