I sold my home to her to make arrangements for her to live here and help pay expenses. She was completely competent at that time and made the arrangements. I was not on the mortgage, but have rights of survivorship deed that was filed while she was still alive. She has passed 2 years ago and i am the sole heir in her will. I did not find any life insurance or other accounts. We were going to fall behind in mortgage payments, so i called to see what we could do and they said they could do a loan modification. That was back in 2007. I was sent paperwork, but they could not talk to me since i was not authorized on the account. This happened 2 more times, they give me the paperwork, i send it in, and they waon't talk to me. They told me I needed and executor's order for authorization and I needed to open an estate. I was sole heir in her will, but I opened an estate to get authorization. So I faxed the letters of office and all the paperwork. This rep called me and I only dealt with him from here on out. He understood we were 21 months behind at this point and we were going to do a Fannie May repayment plan. They kicked back the first installment payment to my bank and my bank mailed it to me along with the letter they sent which stated they didn't know what account to post it to. The account number was right there on the cashier's check. So the mortgager representative called a few weeks later and asked me when i could pay, i said probably within two weeks. He said good and he would call me back. So he called back and I told him I had the money and was going to wire it to them the next day with the information he gave me previously, he replied "Great! let's get this going!" So I paid it electronically the next day and immediately called them to see if they received it and they read back the conf# and everything was good. One week later the rep called me and said he was sorry and the loan modification was broken, and it broke 5 days before he called me regarding the payment, and he didnt see that note. They just took the money and applied it to the account. I do not get a refund, and feel taken advantage of. Our foreclosure case in court will now just continue since it was on hold. I beleive this is Fraud & Financial exploitation of a 3rd party. PLEASE HELP!!!!!! |
