Permanent mod approved. Told we'll receive documents within 10-14 days. So that puts us at October 14th or before.

No tracking number she told me. The paperwork given to the outsource company, Guardian. They compile send it out..... we'll see.

Bob, I have the exact same problem. I have a trial payment due today but I have no paperwork. I called yesterday and a lady said to WAIT for the FedEx package.

Everyday, I run home at lunch and after work to see no package. My stomach turns thinking we are going down the same path as you all have been going down. We also know that getting the Trial Mod is not the end of a possible struggle to get to perm mod. It is just so frustrating just thinking about it!

Very frustrating. On one hand we are promised to receive the great documents and get moving along with our lives, on the other hand we see the reality here on this forum daily and it's hard knowing that there is a chance we won't even receive the documents.

I was just re-reading some of your posts here and saw that you said the paperwork was outsourced to guardian. Did they say that is standard procedure? Our ERT person told us that our paperwork was with a supervisor and the supervisor needed to sign it and send it out. She didn't mention anything about it being outsourced.
Supposedly she even sent a "rush" email to the specific supervisor to get it out ASAP.

Crossing my fingers that you get that paperwork by the close of business tomorrow!!!

Here's the emails from our negotiator.

9/18 - The package has been generated to be sent. Once QA verifies information on the system the package will be mailed to you. Our system automatically updated the loan with new schedule dates of 11/01/09, 12/01/09, and 01/01/10. If you do not receive the package by the end of next week, please contact me.

9/23 - The workout has been approved by our QA department, so you need to wait until you receive your package for the trial payment plan. Your patience would be greatly appreciated. Thanks!

9/28 - I have been trying to find out why you have not received the package yet. It is not that I'm disregarding your email. Like everything in life it takes a few days to handle certain situations, because you have to contact the correct person involved. I have been told that it takes up to 10 working days for Guardian to mail the packages. From the day the workout was approved by our Quality Control department and noted on the system on 09/18/09, the ten working days would fall on 10/02/09. Your loan has not fallen into the Chase HAMP Modification ABYSS, but I am trying to get the correct information before responding to you so I won't keep getting emails daily. She hasn't heard the worst of me yet!!! Looks like I may have misunderstood and that Guardian has 10 workding days to MAIL it...so it SHOULD be to us 10/3, right? hahahahahaha. She didn't like my reference to the 'Chase HAMP Modification Abyss! TOO BAD.

9/28 -Per the manager from Quality Control department the package was noted as being sent on 09/21/09, but there is no tracking number available. If you do not receive the package by 10/02/09, please contact me. I will then resubmit to have the package generated again. I have been told this is normal procedure to wait until the 10 working days have expired before I generate again. Thanks! This email sent the same day as above said the package was SENT on 9/21.....WTF? No mention of FedEx. OH YEAH, NOT RECEIVED TODAY. Starting to look like the BS is being thrown around.....

Thanks for posting that. At least you have a paper trail. All we have is "he said, she said" from phone conversations.

So your documents may just be arriving in the regular mail, rather than fed ex....

Our Executive person told us first that she thought the paperwork would just be mailed to us and that's why they say 10 days. Then she said when she put the rush on it that it would go fed ex. {she did say we will RECEIVE them within 10 days, not that they will mail out within 10 days}

There was never any talk of a QC department or guardian.



Waiting is the worst.

I went through this a month ago, I was extreemly sincere and persistant with a gal in Florida.
She sounded embarassed but told me she had to send my call to Costa Rica to get approved.
Huh? Major head's up here, non US person looking at my personal bank records? Sorry I feel that is a breach of client/ banker privacy.my monthly payment was more that what I was paying and I could hardly understand the guy talking to me. I got the FED EX it was non HAMP and thier version of a workout.
Hud verified this, I faxed all papers to them, they have to be stamped HAMP Approved. 1/3 of your income. or 31%. I am doing well in the debit catagory so I know my other payments is over.

Go back and say Costa Rica??? Who Are You???. I refuseed them,and I will not pay,I am better off going past 3 month's. They see that as a loss and then they negotiate. If I loose it I dont care, they need to eat the bailout money they refuse to help with.

OK, our housepayment was one month behind when we started the loan modification process, however, it was put on our Chapter 13 Bankruptcy and they will have disbursed money to catch up on that payment this month.

We have decided that if our trial mod package has not been received by the 14th of this month (we have until the 16th as a grace period for payment), we will NOT make another payment.

Didn't I read that we must have 30 days prior to the first payment on the mod??? Our first payment was to start 11/1????? If so....that timeframe has been missed.

Chase does not have any sense of time and dates. Chase FedExed my bogus ($700 more than my original payment) trial plan to me on Sept 7th, I received it on Sept 9th, and the letter/trial plan enclosed was dated August 8th.

So how does it take a month for them after everything is ready to send out, to put it in a FedEx envelope and send it? Who runs a business like that?

The letter said they needed it signed and sent back with first payment by Sept 1, since I did not receive it until September 9th, I guess I have until Oct 9th before they start foreclosure...not sure about that.

We finished our trial mod payments back in August. We were told our final mod was done in early September and the docs were on the way. Here we are in October and still no paperwork. I have pretty much given up. I don't think Chase will ever come through with a permanent mod or if they do it will be too late.

Sono, we are 7 months behind and it's still a struggle with Chase. So don't think that just because you are behind they will jump in and everything will go smoothly.

Don't give up! I know we are earlier in the process than most (started 11/08..., but 3/09 direct with Chase), but we are going all the way on this one. What the hell. Nothing to lose, credit shot now anyway.....banks are a mess. Bring on the Sheriff to evict us when we do not pay and foreclosed upon.

my negotiator said the first payment can be late, we got our trial fed ex on 9/4 and we sent in our payment on 9/12, the point is that the first one can be late...yesterday I made our second trial, so the 2nd and 3rd have to be done by the 1st of the month, hope that helps

No we decided to stop making any more trial payments. It was a difficult and calculated risk to stop paying. However, after reading all of the posts on this forum and speaking with numerous others we came to the conclusion that while we did get the official MHA paperwork for our trial mod, there is no mechanism in place that we can see that actually holds the lending institutions accountable in terms of following the MHA guidelines. Consequently, all of the chips are stacked in the lending institutions favor. If they decide to deny us in the end there is really nothing we can do about it except complain and try to start over again. I am convinced the more money we give them after finishing up our 3 month trial period only enhances their position and degrades ours. It seems that one of the things they are looking at is the NPV test and our ability to pay at a new modified amount. Therefore, the greater the loss that they will take by foreclosing the better the chances are that they will give us the loan mod. Right now if they foreclose on us they will take a hit of at least $200,000 while if they give us the loan mod, they will not take a loss on the principle but they just won't make as much interest. The other reason why we stopped paying is that we have had so many phone calls and letters from our lender and it has convinced me that they have at least three different groups of people or departments working on three different loan mods for us under the MHA and maybe even an in-house mod program. With this level of confusion on their part I really doubt we will ever see a final mod any time soon. They are so confused and their systems are so "non-connected" that I am convinced they are just spinning their wheels around and around. In any case, I'm hoping that by not paying any more payments they will keep seeing the loss mounting and then they will eventually just cave and give us the mod. We realize we may be wrong and get kicked out of the house, but we can't afford the original payment anyway and I just can't see forking over more money each month for a loan mod that may never happen.

I told them NOT to transfer me again! That my negotiator’s voicemail said to check on status, call Bankruptcy…..she said “Why do you want bankruptcy, you aren’t in bankruptcy! I told her we were. But you are working with the modification need to call them.

My husband is going to be calling within the 1/2 hour to check the status of our account. Unfortunately, I wouldn't be surprised if we are back at square one. Things change daily over at chase. Still hoping and praying that things are moving along though.
