One response so far from the many complaints I have filed, since being denied the final modfrom our friends at Chase.

The email from HMP reads as follows:

Hi Evan

Yes a negotiator from the bank has been asigned to me. I was put on the trial mod for 90 days and then denied. They want to offer me another 90 day trial but I am refusing because I am filing Chapter 13. My lawyer said don't go along with it again, They are just stringing you along. I believe him because he does this everyday. I am hoping that the cram-down will be revisited as part of the finance reforms that the House Democrats plan to take up later in the year.

Based on what I have received as for a response from my TARP complaint, and a few others, this response should be considered a positive that they might actually are looking into your complaint.
I take it that you were on HAMP trial, they rejected you for perm mod and now want to put you on it again? I Have never heard of back to back HAMP trials.

Got your $5500 from getting people on to COMPLETE a 3 month trial?

Hell, rack-em-up again...let's trial mod them for 2x the bonus! Them american taxpayers sure 'nuff know how to take care of us big fatcats who don't actually work with their hands.

Screw the Percora hearings...I'm ready for some public tarring and feathering.....and I mean that. Want to teach them a lesson? Make THEM pay.

Republican OR democrat...they are both controlled by the $$$, is it not apparent after all this time and all these failed "wars" and policies?

We need at the least a political revolution.

This is the latest email I sent to the Hamp Agency today and I copied a rep from the US Treasury. I've had it with this bank and its' bull!

To Whom It May Concern:

I am sending as a pdf attachment, a letter I received today, from Chase, attempting to explain why my final modification under the Making Home Affordable Plan was denied. The only reason Chase sent me a letter was due to my insistance for a written denial. The aforementioned letter is a bunch of jibberish, that makes no sense and does not follow President Obama's HAMP Guidelines.

My understanding of the Making Home Affordable Plan is that once a modification trial is offered and the borrower pays the three monthly payments on time; a permanent modification is offered. The following is copied from The MHA Website.
  • If you successfully make all of the required trial payments during the trial period and the income and expense information you provided is determined to be accurate, your servicer will execute a permanent modification agreement.
In the HAMP Guidelines it states nothing about the interest of your current loan as being a factor for denial. The following was copied from the MHA Website:
  • Treasury is providing incentives to your servicer to write the interest down to as low as 2 percent, if necessary to get to a payment that you can afford. Each borrower's interest rate will only be reduced to a point sufficient to get the modified payment to equal 31% of the borrower's gross monthly income. Not all borrowers will need a rate reduction to 2 percent in order to achieve a monthly mortgage payment that is affordable..
It is obvious that Chase is creating arbitrary guidelines in order to deny final modifications, while buying time, in the event the housing markets begins to show an upward swing.
