Chase rep will only fax contract?

Has anyone else been told the rep can't mail or Fed X an initial contract for our signature, that they have to fax it to us? We're bothered by this (not to mention thinking, like everything Chase tells us, it doesn't make much sense) because our home fax doesn't work, and we're not comfortable receiving something like that at a Kinko's or other such public place...and since it's not like you can be on the phone at work and say "ok, fax now" my husband doesn't want it fax'd to his office either because he would have no control over being the one to actually receive it!

Hi lainy09,

I have absolutely never heard that before. Usuall the lender will always send any kind of documents via mail/fedex. You sohuld call back and speak with a supervisor/manager because that is completely unacceptable.

Evan, Thanks so much for the reply. So I wonder, if I tell them there is no way to fax to us, what will they do? The deal is off? Geez....I'll send them a couple of stamps, haha.

In some states, a fax is a legal real estate document. As long as it's signed, you have confirmation & you confirm they received it via fax, it's the same.

I believe a faxed contract is a legal document in all states as long as all parties to the contract agree to accept it as legal. A contract signed online with the mouse is also legal under the same guidelines - I think President Clinton was the first one to sign a contract with a mouse? It is an ugly signature but it is legal.

If the banks were really on the ball, they would do an email contract that you could sign online with the mouse. More people have access to a computer than a fax machine and you do not have to worry about hard copies with private info getting into the wrong hands when it is done online.

Most states do allow for faxed signatures although this does sound unusual. I try and get a place to fax to and see how it reads (have attorney review). You dont have to go any farther with it. It sures seems like they are playing hard ball with you. I wouldnt give Chase a down payment and you might want to suggest a deed in lu just to see what kind of reaction you get.
I dont recall Lainy how underwater you are but I surely do not like what Chase has pulled on you. It should be illegal. I'd take as many free months of rent for as long as I could and tell them to shove it. They are bastrds.

I agree with Evan. I would call back and talk to a supervisor. There is something about this that stinks. Whom ever you are dealing with sounds like they are not operating in good faith at all. Not that any of them are but this person seems unusually so.
