Additional Trial Mod Payments

Thank you Paul, Nathan and other attorneys for having the patience to help out here.

I assume by now that you have been able to read the HAMP Trial Mod Contracts that many of us have signed and returned to our lenders. These clearly state in the language that we are to receive signed copy back. My lender is Chase and they will not provide me a signed copy of the contract back. Im not an attorney but I am thinking, its not a binding contract until it is signed by the lender.

Is there something I am missing here? Chase says its just an informal agreement and they are not required to send it back signed.

Also many if us have completed the 3 mth trial payments according to the contract now many of us have been given a variety of statements from our lenders to continue making them. Chase told me today, I will be denied a perm. mod if I dont make more trial payments regardless of the trial mod contract.
Can you give us some guidance here? Many of us are in the same boat and some have made 4 & 5th payments only top get rejected for the HAMP perm mod.

Great post. I'm not a lawyer either. I could swear that both parties must sign an agreement for it to be valid. Hopefully a lawyer can clarify this.
