Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | I have a general question for anyone! Help please! I am considering the impact of a Chapter 13 filing in AZ. For expenses, I have two credit cards, two cars (one leased w/12 months remaining, and the other with about 36 months remaining on the loan). I own a home with a mortgage (upside down by about 70k) and a 45k heloc. In addition, I am on the title (with one other person) of a small undeveloped lot, less than one acre that is paid for, in rural AZ. The lot has been listed for over one year, without any offers. We are a family of four. My family's income is about 20k below the Means test for AZ. it is my feeling that I would most likely not incur any re-payments to my unsecured creditors (including heloc?), because of my Means testing. My questions are these; since it most likely impossible to sell the lot (there are over 100 similar lots for sale in the area, so the value of my share is minimal-less than 15k?), will being on the title cause complications in a Chapter 13 scenario? What would happen to the lot if I cannot sell it? I understand most of the process, I just cannot find anything that can educate me on what occurs to the lot. Hopefully some of you will have an opinion... i promise not to hold you to it! Thanks in advance, Skipper |
