I had a separate property in my name only and it is in foreclosure. The HOA had sued me for past dues and won the judgement against me. However, I am appealing the judgement because I do not agree with the extra charges HOA had claimed. There is no court date set for the appeal yet. In the meantime, can I quitclaim to remove my name from my husband's property? He is in the middle of a loan modification with Chase and had completed the 3 month trial period. I realize that I am ultimately responsible for the HOA dues and the appeal judgement would favor the HOA. I am hoping that the judgement would not be the full amount HOA is seeking. Please, help...can I quitclaim from my husband's property? We are in San Diego, California. Thank you in advance for any input that you can offer. |

Such a question should be asked of the lender directly - as such a transfer might mess up the modification. - Paul
