I hired a company AFS modification co. to process my loan modification for CW. AFS is an affiliate of the Law of MIchael M. Yellin. I called attorney Yellin to confirmed that AFS is his affiliate and he said yes. When I started my loan mod I didn't know about loansafe.org so one day somebody called about loan modification and I got hooked. I paid them 2400 just to process my case. After 6 mos. of resubmitting paperworks to there office plus the company negotiator that handled my case resigned I didn't got nothing from them, in short they just fooled me, waiting that I will have a loan mod. I got 6 mos. behind from my payments because of there advised not to pay the mortgage. I got shocked last week when Michael Yellin send me letter stating that my paperwork already submitted but unfortunately they can't follow-up my case and they will not accept phone calls from there customer. How very sad |

I am sorry to hear about what happened to you. It is very important that before you hire a lawyer or any company that you should check the State BAR of CA to see if the lawyer is licensed to practice law and when they started to practice law or check the Better Business Bureau if they have complaint against this person. I checked this lawyer online at State BAR of CA and found out this lawyer started practice law on Janury 4 2008, I found his office address and other information about him. Here's the link for that and check it yourself. State Bar of CA :: Michael M. Yellin If you have checked him out first then you will not hire someone who is new to the field, you need a Real Estate Lawyer whose expertise is in Loan Modications and Short Sale. The first thing you need to do is to write a letter sent it via certified and copy the contract and highlight the part that in the event that you don't have a sucessful modication with him that he will 100% return it to you. Demand in your letter that if he does not return the check in one week that you will report him to the State BAR of CA, State Attorney General Jerry Brown, report him to Better Business Bureau and contact the media. If he is a lawyer with moral values and integrity and true to his word he will return the check to you. God bless and take care.

If you hired an real attorney law firm (as opposed to yee olde attorney-backed loan mod shoppe), and did not get the results you desired, it's time to sit down with attorney and see what else he or she can do (AKA Plan B). Communication with your attorney might show that he or she did do what he or she was hired to do. If not, then complaints to the appropriate places are an option. My firm has been encountering a nasty power play by lenders recently. When some of our clients have called the lender directly to check up on us (as they often do as a result of all the worries about scammers) the lenders tell them they never heard of us. This is told to our clients even though we have been in contact with then lender, have emails and documents to prove it, have the negotiations half done, etc.... the lenders are driving a wedge between lawyer and client to the advantage of the lender... so, just a word of caution... before believing your lawyer has not been working with the bank... give the lawyer a chance to do some splainin' - Paul

I've been contacting with him but he never answered any call and I leave how many message but he never calls me back. I e-mailed to him about what happened and he never replied to me. I guess I really have to report him to attorney general's office. I have my contract here and his letter so I will do what you said and send it to attorney general's office. Thanks for that advised. I'm just frustrated and it's just too sad. |

Not that it happens often, but it does... some of our clients are under intense pressure of losing their homes and get very antsy when my office does not call back within 24 hours... and I absolutely hate it when a client threatens to report us to some agency or other... but it does get my attention and the attention of my staff... it also puts a wedge between attorney and client so it should be used only as a last resort... send attorney (by regular mail and by certified mail and by fax) a letter saying you will take your complaint to the proper authorities if you do not get a call or a meeting... if that does not work, you at least fired a warning shot. - Paul
