There seem to be some issues here NOTE: all this was done under countrywide who is now BofA and none are in my name only my husband since all this was done before we got married. My husband had these mortgage loans before we were together BUT here is what he told me before he refinanced for the loan he has now(done in April 2006) the one before that listed him as a "homemaker" with his ex (they were married at the time) as the primary. BUT he was actually employed but was on OJI ("on the job injury" and under a reduced pay) and was going through medical care and went right back to work when he got better. It just seems wrong to me and he said that he was against it but the person doing the loan said that since he was under reduced pay and making less than his wife it would be "better" to list him as a homemaker. Also, I'm not sure if they can do this but person also doing the loan told and was in agreement with his wife that as soon as the payments went up after 60 months on the fixed intrest only loan just refinance again and litteraly just keep on refinanceing. What kind of advice is that? There's more! His wife like to spend spend spend. And forced him into refinancing a lot. But while clearing out some old stuff I found some of his ex's hand written bill notes on a notepad and noticed that there seemed at one point they had 2 SEPRATE mortgages, in the notes stating a 1st and 2nd with 2 diffrent pay amounts with in the same month. He says that they have only refinanced and never had 2 separate mortgages. Can he find out and get copies of ALL the old mortgages he had to find out what was really going on and where do we get these copies? I get the feeling that in the loan I was talking about above, his ex and the loan person may have sneaked in and combined two mortgages in the refinance and kept him out of the loop of what was going on. ... His ex is a really sneaky person. Also if legal violations are found in these past loans can we use that in negotiating the loan mod we are currently trying to get on his current mortgage? |
