A Notice of Sale must then be recorded 20 days prior to the sale date itself. Keep in mind these dates are from day recording, not day received by borrower. always check the date recorded on the form.

The earliest the NTS can be filed is September 6...then the earliest auction date is going to be September 27 (the 21st day). In practice (searching through filings), it's usually not exactly the 90 and 20 days, I'll usually see ~10 days tacked on to the end, you're probably looking at an October auction. Just curious...when was your first missed payment and who was your lender? |
