Nominated 0 Times in 0 Posts TOTW/F/M Award(s): 0 | Why some people cant get a MOD Judges across the nation, including Boyko, Rose, Kurtz, Schack, Rosenblatt, Bufford, O'Malley, Shaw, Bryant and Foley have issued orders dismissing foreclosures brought by lenders that have illegally securitized loans and are no longer current holders of the notes. These "quiet title actions" have forced lenders, including Chase, Citibank, Wells Fargo, Washington Mutual, Countrywide, Lehman, Shearson, Indymac, Bear Stearns, Wachovia, and Bank of America to unravel their notes' dizzying journey from the mortgage closing to an investment bank or depositor, then to a series of trustees who pooled and sold the loans and issued shares of mortgage backed securities. What makes these securitizations illegal is how fraudulently they were conducted, by foregoing proper assignments and transfers required by law to secure an interest in the underlying real estate. While this is devastating news to taxpayers who will be stuck with more debt, it is great news for homeowners' with securitized loans. Ironically, their mortgage lenders' haste to securitize their loans has provided a security blanket that protects them from foreclosure. In fact, many homeowners already own their homes free and clear and just don't know it yet. Maybe we should start asking if CW can produce the Original Note with your signature on it |

Actually, I think some lawyers are using it as a stall method but if it keeps you in your home longer, good. Wash has not heard or cared about the homeowner that is clear. Banks got money and still don't lend even to qualified. What the hell? Could it be a master plan to get folks out of their homes then enslave them to the point they will accept anything the govn't does? Create a class of such ticked off, disgruntled people who then will vote for more gov't assistance in any form since there are no jobs, money, homes they can afford on any level? Sorry for the side rant just thinking..... |

In my own way I have been trying to express this and to see others who can and have wow thank you! I too have the same question where can we go to get help we need to fight this? After months of searching that question still goes unanswered. My lender wants to foreclose!! I have had the hardest time finding help with anyone that gets that perfectly clear fact. It is almost oh you have that lender nah we don't do that. My time is getting short to save my home now so if anyone knows how to get the help needed please share. Thank you, Catherine |

Very few replies, but they would not take my case for various reasons. Time and distance played a factor. But , I know from previous talks with him that he is reluctant to refer anyone to a certain attorney and I can understand that. Someone's going tyo "get it" I just hope its before I lose my properties. |

I had not been overly impressed with how the Ch.13 was handled so I told him no. Maybe I should have said yes. Hind sight is great huh? |
