    What about missing "paperwork deadline" for BOA modification agreement?

    I discussed the details of this in another post, and I always get stressful news from BOA on a saturday , in the mail, after customer service hours.

    What I'm talking about is the letter where it says "please return by" and "make first payment by". I'm well within the deadline of making the first payment, but missed the paperwork deadline of august 26th (i think i got the mod app just a few days before) I know I had a similar problem with the trial payments, and they were granted, but I was only a few days off.

    Whenever I have called BOA , I have not been able to get in touch with my "agent" , except for the first time when I signed on for the trial payments. So, I'm a little stressed about this heading into Monday, and potentially not even being able to speak to someone then because the service is so horrible.

    Agreed. You are not alone on this one. For four years I have jumped through the hoops with Chase, to get paperwork back within the time limit, while their mail to me is dated a full two weeks sometimes before I get it, so half of the 30 days is gone. Same situation of bozo people on the phone who have no clue what the word home or loan means, and never able to get the Relationship Manager on the phone, which also changes every 6 weeks. They are the alpha fraudsters and they are making the rules, or so they think. All I can say is document, document, document. Keep track of every date something arrives, with its date of being sent, and likewise when you send paperwork back.

    Well , I think in this case, the letter says to simply "mail" the paperwork by their ridiculous early date. Then emphasizes the first payment at month end. So, unless I'm missing something, they can't prove I didn't "mail" the paperwork to them no more than I can prove they did or did not get it. Looks like I have a long week of calling and trying to "track down" my !@@#$$ agent :-/

    There are two ways to document when you sent something. By faxing it, you have the printout of it going through. I would also call every day for a few days to verify how many pages were received, and always document the names of the employees on the other end with whom I spoke. Another option is to send it via certified return request mail. It costs a bit more, but you then have the card which they must sign for and send back to you, via the postal service. They will lose it all over and over again, but it is about documenting how they intentionally deny and thwart making modifications. Document every time you call and the call gets dropped or you are unable to speak with your rep, or get passed to voicemail. Document,document,document.

    So at this point have you already made the three trial payments and they are denying you the permanent modification due to the paperwork not being sent back in time?

    how long is a estimated/proper decision time on your mod? we sent in our papers & they recieved them on thurs. sept 6, is it a certain amount of time or case by case basis, just wondering as our bankruptcy is discharged, we got in contact with BOA, they fed ex'd the info we needed to send in & we did well within the time frame they gave

    UPDATE, and PLEA for help.

    I've come so far in trying to save my home. For months I was virtually unable to get in touch with this relationship manager. The bottom line was that I desperately called and ultimately found my "single point of contact" back in September. She told me to send in the paperwork along with payment by the due date for my permanent mod. She said that even though I missed the paperwork due date, getting it in by final payment date should be OK. I wish I had a recording of the call, because apparently that's not correct. Even though I was really struggling, I did this, and sent rush mail with certified funds.

    Now, I finally got in touch with my now THIRD customer service rep, and have been told that BOA summarily denied my modification because of that earlier "paperwork" due date. The current "word" is that she's going to try to see what can be done, but I've had nearly nothing but bad luck with BOA, and the only time/reason I got this perm mod offer was because they got 6 months of payments from the Hardest Hit program.

    I really need a good suggestion on what to do here, besides "hire an attorney" because I have ZERO dollars to do that. The loan has "gone back" to regular servicing, so they are sending the hate mail again. However, they just "applied" the payment I had sent for the permanent mod to my long delinquent mortgage. The mortage is behind about 10K, and the second mortage on this home, also with BOA, was recently forgiven from the government program.

    I'm assuming the worst, and again wonder what my best path would be since I want to save my home or at least stay in it as long as possible. No foreclosure proceedings have started, and even though it's another BOA horror story, I just can't believe they would want to deny me a permanent mod that they actually sent me pre-approved. This was/is a HAMP mod. Thanks.
