    I am starting to get panic attack...what to do? sales date 07/30/12 trustee site

    Just 2 days ago...I was excited to received a full forgiveness on my 2nd from BofA based on DOJ settlement.
    And now, I am panicking because I still have sales date showing on my property on July 30th, 2012 with 4 days more to go (with 2 days are being weekend).

    MY CRM out from office Jul 23 - Jul 30th.
    Called his manager Tue, Wed and Thur...
    no calls back from them.
    Called OOP Wed and Today to request postponement but it still not being processed yet until now.
    OOP agent told me there is no guarantee bla bla bla with the request.

    Then later, 30 mins ago...
    I received a call back from my crm & my crm's manager's boss' assistant.
    She is saying that there is no sales date...but trustee needs to have sales date and has right up to 24 hrs to remove it/extend it (I DONT EVEN KNOW IF THIS IS TRUE OR NOT....)

    from my experience, This will be my 5th postponement date...This is by far is the closest they are trying to postpone the sales date and I have completed my 2 trial payments out of 3.

    I hate to see they screw me over this....

    What else should I need to do now beside waiting until tomorrow and try again....

    Confirmed with Trustee that 24 hrs is the new guideline now......
    tomorrow is the earliest i can see it/get update on it.

    Data point:
    Per conversation with Quality loan:
    Quality loan is no longer accepting postponement request from BofA when there is a work-out or ON HOLD file.
    Bofa isnt seeing this sales date (like what my CRM kept telling me..no sales date), but there is a sales date on my property (per Freddie Mac Instruction).
    The postponement will be automatic as long as my case on hold in 24 hrs.

    oozze, I feel your pain and I am sorry for the stress you must being feeling right now. May I ask who is your Trustee? Prayers going your way>

    This is BS Oooze that they are stringing you along like this. If you just made your 2nd trial period payment all foreclosure proceedings should have been placed on hold and they should not have set a new sale date until they made a final decision on the modification. Even though they are agreeing to postpone the sale I would make a complaint to your state AG, senator, OCC, etc because this is just not right and it is likely next month you will go through the same thing because sale dates are generally only postponed 30 days..

    @Maggies: Thank you. It is McCarthy & Holthus. But when you call the number it has options for foreclosure, it will get directed to Quality Loan. The CRM that called me yesterday doesnt know who is quality loan.

    @Evan: my file is on hold per conversation with BofA's CRM. Bofa cant see any sales date on my property.
    However, if I go to the trustee website or made a call to trustee (quality loan), there is sales date.
    I even confirmed this with a guy at quality loan that bofa cant see it, but there is an sales date on my property with my trustee no.

    I dont see myself a lucky guy. I worked and put too much efforts into keeping this home for my family. And, last monday, I receive a miracle by receiving a forgiveness letter to my 2nd LOC from Bofa.
    So, I hate to see that all these ruined by a simple human error (forgot to update and etc).
    I hate to see that I am in less than 1% chance of error pool, because sxxt happens.

    I completely understand the reason for leaving a sales date on my property.
    Reasons are: too expensive to put it back when it has been removed, In case i am default again, the sales date can be effective right away, and bla bla bla...
    But, bank aware that i made my 2nd trial payment on Jul 1 (posted on Jul 2). That should well indicate that I passed Jul Mo and going into 3rd trial payment on Aug 1st.
    I believe, right away after July 1st (maybe a week or so), that date should automatically extended to the next month. (Aug 30).


    I dont know....
    I spoke to a guy at quality loan yesterday. He said today I should be able to get a new date.
    I just made a call there...and I am not able to reach him.
    and the rep told me the notes says it will update tonight....and I cant get transferred to him to leave a voice mail or anything....
    I am giving up...

    I know I should not/ will not lose my home for their errors especially when I am in trial payment.
    If Sxxt like that happens, I can sue the bank.
    But, suing takes time and effort which i dont have and I am truthfully exhausted.
    I just dont want to go that route.

    Thank you for reading. I just feel the need to get it out.

    I'm so sorry and I definitely feel your frustrations and why you feel like giving up. You have been battling BofA for a few years now and I pray your hard work and due diligence all this time will give you success. After all this time you would think different departments would communicate better with one another but this is just ridiculous..

    Oh..I am not giving up. I am giving up about caring too much for their errors.
    I will definitely keep this home.
    All I have for my son.

    Yupe...You really thought that their are more informed that you are and they should communicate better.

    The CRM that called me insisted that he doesnt know who is quality loan and tell me to call trustee number @ 619-685-4800.
    This number is different number than I called earlier(and the paper was in my office)

    I kept telling him if he has internet access, I can direct him to priorityposting.com and punch in my trustee # and he will see sales date.
    He kept ignoring that...and kept saying no sales date and he doesnt know who is quality loan.
    This AM, I called 616-685-4800...for foreclosure option#1, it goes straight to quality loan....

    And another stupid things, he called me again yesterday (after conversation) and told me he as update and wants to speak to me either last night or this AM.
    I called him this AM, left voice mail.
    He called back around 9.30, and looking for someone else.....
    and, he said he will call me again later...
    Hmm..thinking about it...the name sound like the old owner of home

    He called....

    He said he just called the trustee few minutes ago, and he confirmed the sales date is Aug 29th, but insist that this date is not anywhere in Bofa 2/3 systems.

    I am surprised the date now is Aug 29. So, I went to refresh my priorityposting.com site, it is now Aug 29th.

    Data Point:
    No one knows shit at these companies ... <-- my worries.

    BofA CRM: doesnt know this date until i kept telling him so many times. Or, they really dont do their work but just reading whatever the in their "magic" 2/3 systems. U know, human entered information into the system...so you can expect errors there!!

    Trustee: yesterday, someone told me bofa cant request anymore. This AM, someone tell me it will update it tonight with the night crew.

    15 minutes later: the date changed from Jul 30 to Aug 29th after CRM made call to trustee.
    Coincidence???? I dont think so!
    This is why i am always worry.

    oozze - Good Job on getting the postponement. Please go over to priorityposting.com & take a screen shot & download to your desktop so you have evidence the sale date has been postponed. Don't let your guard down though, keep checking it on a daily basis from now until then to make sure nothing changes.

    I remember reading long ago in the Ca. state statutes that a beneficiary can request a postponement of trustee sale a maximum of 3 times. Well, I'll tell you from personal experience it doesn't hold water since I've gotten my sale date postponed by the beneficiary far more times than that!

    What good does it do to have rules when nobody is going to enforce them! lol
