    Requested to see my Note from BofA red flags Please Help

    Hello,
    This is the first time I have posted here I have gathered alot of good resources to help with my 2 1/2 year modification night mare with BofA, I just last month went to court house and got a copy of everything they had of file for the note and this document they sent me is no where in the paper work court house gave me is this a red flag? and I hope that others that have a little more knoledge of BofA tricks could help me point out more red flags I have attached note to this thread if there are red flags I would like to challenge BofA on this. PLEASE HELP

    Hi leterbuck - As cat suggested, you may want to get some sound legal advice from an attorney by going to the link she posted. Another option for you is to go here My recent letter to BofA (Part 2) & post your documents. Many of us on that thread are quite familiar with the RED FLAGS to look for. If you decide to post the docs, just be certain to make copies first, & black out ALL your personal identifiers first before uploading.

    Hi All, I followed the recent letter link, and took the advice of freedomwon...sent recontrust a dispute letter and requested copy of note..cc..bofa...recon told me I could not get a copy until the note was paid in full..bofa sent me a copy of some partial note...a few weeks later received fedex letter for approval of doj mod...made my first payment last week..here's the thing..we received another fedex letter from yet another dept of bofa their "copy" of our note...bought the house in 2003, paper work they sent starts in 2006..also had a notarized page in there, notarized in orange co, ca...we never went to the OC..but the other important doc I received was the page showing who our investor is...HSBC...this is news...we were told in 2010 it was wells fargo.
    Our doj mod is fair and affordable for us...anyone else now dealing with HSBC as investor?

    Mortgage backed securities are pooled and sold a number of times over the life of a loan so it could very well be that WF was the investor on your loan at that time when you were given that information and still may be. Have you tried putting the information into the MERS site to see what comes up?

    Actually, HSBC is a private investor and this is the reason you got the modification. These DOJs are the best modification out there as principal is forgiven. You are very fortunate and I would no rock the boat with the note thing as that argument goes nowhere.

    I went to the Mers link..It went back to 2004...mortgage co Saxon..status inactive, and unable to get further info. Not real sure what all this means, saxon was prior to countrywide. your thoughts

    It was just an avenue for you to check, but isn't always the best most up to date information. As Jeffrey mentioned, you received one of the best modifications out there with the DOJ modification, many homeowners are unable to be considered for this program, and you would not have received that if HSBC was the investor, but you could be included if WF was the investor. With receiving that modification, I am not sure why you would still want to press the investor issue.

    I am not pushing the investor issue...wanted to follow the link to see what came up. Above Jeffrey mentioned HSBC is a private investor and this is why I was offered mod, you state I would not receive if HSBC. Again I am confused. I am only seeking out info so that I can prepare myself, and I suppose I shouldn't worry what happens with others, because I am in the trial period, I can only take it all one day at a time. Thank you, I"m sure you understand my desire to know the truth.

    I am not speaking to your desire to know the truth as I would be unable to understand that, unless I was going through something similar. I was only speaking to the fact that you received an approval for a very good mod regardless of how you came about it. BofA can only offer it to the loans that they were able to as a result of the consent judgement against them. What I was saying is in this case you would have to have a loan backed by one of the investors that the settlement includes in the consent judgement for BofA.

    This is how it is written on BofA's site;

    Customers must have a loan owned by Bank of America or a loan held by a mortgage investor that has delegated authority to Bank of America.

    Apparently that looks like it would be the case with your loan and those are really good modifications that I wish more members were able to achieve.

    I am new and have read many stories here. I have been working with BofA on a loan modification and have been transfered back and forth with account reps. This is a nightmare..... although I expected it would be. Yesterday we were served. With the papers, I did receive the recorded copies of our mortgage and note. However, the Mortgage was never notarized? Anyone have this happen tothem?
