    Help? Paid 1st trial payment a week early and they didn't apply it as 1st trial payment!! Now 1st trial payment is due!

    I received a trial payment period offer in May. The 1st payment was due by July 1, 2012. I made the payment on June 18 using the coupon and envelope BofA provided with the paperwork. Today I was informed that the trial period didn't start until July 1, and that payment was processed but not applied as the 1st payment. All paperwork clearly states make payments "by" July1, August 1 and September 1. It was paid "by" July 1st. My "account manager" states that there's nothing he can do, clearly the payment wasn't processed properly. I've left a message with his supervisor, but I don't think I'm going to get anywhere with him either.
    Is there anyone at BofA I can contact or do I have any hope at all of getting this payment applied properly?? I'm so frustrated by BofA, we've been dealing with this for 3 years now! I don't trust them to do anything correctly. Advice, anyone?

    Hi Mel,

    Just wanted to share my story.

    This also happened to me, got an offer letter to participate in DOJ program on June 11 via fedex (after previously applying). Letter stated if I wish to accept I muse make first payment by July 1st (pretty dam short notice btw), and then 2nd by Aug 1st, 3rd payment by Sept 1st.

    I called the telephone number on my DOJ offer letter and made 1st payment on June 19th. Two days later I verified the payment was received.

    July 3rd I start getting automated calls from the bank about 3x a day, missed all of them but called back, got forwarded to CRM who wasn't available. Pressed 2 to make a payment, got a person on the phone and asked them why they called, they didn't know but transfered me to another person who then told me my payment was applied to the month of June, not July and my July trial payment was still due.

    The person I spoke to on the phone said I need to speak to my dedicated CRM about it, so I called, not available, left a message about it.

    July 5th, July 6th, 3 more calls from automated recording at bank asking me to call. Again, I called, got routed to CRM, who is unavailable, left voicemail both days.

    I have been fighting and trying to get a mod for 3.5 years, In foreclosure, current sale date set for mid Sept (California).

    I am worried I could now lose my opportunity to get the mod because of this error the bank has made with my payment and I definitely cannot afford to make a double payment just to fix their error (and not sure I understand exactly when to make the payment to not mess things up more anyway or have it count toward the wrong month).

    I read my trial plan paperwork ten times and also people on here were warning me about this.

    My paperwork says 'We must receive each payment on time AND IN THE MONTH IN WHICH IT IS DUE.

    But your CRM's should have also told you that. Mine took the info early but did not post until the 1st of that month for June and July so far.

    I think it is ridiculous for them to not apply it - why put you thru all this? I hope you guys get it all straightened out!

    Same thing happened here....I was told it would be corrected so keep at them cause it is possible. Good luck

    Hi Cat, according to our "Escalations Advocate" at BOA they received our full trail mod payment and told us to ignore all correspondence that states otherwise (yes, I have all of this in writing...learned that the hard way). That was our first payment (July) so 2 more months to go. I'm not sure why they are calling it a modification since our rate and terms stayed the same. They just added the past due amount on to the loan and increased our payments by $1500/mo. I finally purchased the RestReport hoping they will be able to help us at least get our terms increased from 22 years to 30 years. We are waiting a few more weeks to complete the report as our numbers have changed (husband got a raise) and we are hoping this puts us in the NPV positive. I'm not sure what to do if BOA won't budge...we can't sustain at $4551/mo mortgage. I'm re-reading all the threads here and trying to develop a plan B. Thanks to this site, I feel much more equipped!

    Resolution.....

    Thanks again Cat for those contacts. They were responsive to both my email and phone call. Long story short, I was assigned a new CRM and spoke with her on the phone and received written correspondence from her as well. Today I received a letter from her stating that the payment made on June 15th will be considered the first trial modification payment. We'll see how it goes from here.
