    Modification was never closed! Boa lost all signed docs from mod in 2010!!

    Please let me know if anyone has had this happen to them before or can offer advice. My husband and I completed our HAMP in 2010, at least we thought we did. We are in the process of doing another modification because I have lost my job again and I am pregnant. I have not heard from BOA in about 10 days so I called. My CRM tells me that I am technically still in trial payment status!!!!!!! I couldnt believe what I was hearing. All the paperwork was signed in 10/2010 and the partial claim was filed with the County Clerk's office that same month. How can this be? My CRM says they do not have any of the papers that we signed , which makes not sense to me, the partial claim (we have an FHA)
    is filed with the county clerk's office. He said that we can not go any further until this is resolved. No Kidding!!!! I am very concerned. I do not want to get screwed some how by BOA. I do not trust that they ever had had our best interest at heart. This concerns me very much being that my son is due to be born 7/29. I do not need this stress. Has anyone had this happen to them before? Anyone have any advice? Luckily my mom works for an attorney so if need be I will have representation. On thursday, I am going to fax a copy of the partial claim to my CRM so he can see that at some point they obviously had the signed docs.

    By the way, love this website. It helped us get our first modification done. At least I though it was done. This website is a great resource. I am lucky to have found it.

    Do you have copies of signed mod paperwork?

    Yes I have the copies but would you believe when I asked my CRM if he wanted me to at least fax them he said it wouldnt help!!!! That makes no sense to me. He said they are looking for the fully signed copies. Meaning, the copies that the bank signed after we signed the docs. I can not believe the incompetence. That is why I am faxing them a copy of the recroded Partial Claim tomorrow. I just hope we do not get screwed by this. I do not trust he bank for my CRM.

    If you have signed copies from the bank with your signature and the bank's signature; it is a presumed contract and if they go back on it; it is a breach of contract. I would see a lawyer.
