    Please Help!!!!

    Ok I have been looking through these threads and I have no idea where to start! We are about 5 months behind on our loan with BoA and have been trying to get a loan modification for about a year now. We turn in all required paperwork then they say we don't qualify because they need paperwork. So we call BoA and they reopen our case just to tell us the paperwork they need is stuff we have already sent in?!?! They say it closes because the paperwork expires! We can now make our payments all we are trying to do is get our back payments put on the end of our note! It seems like we will never get help and are very tempted to just walk away from our home

    Hi coler - Sorry to hear you're having such a hard time getting anywhere with BofA. As you read through these threads, you'll notice it's not an unusual experience you're having.

    It's time for a new approach. Send an email to the Office of the CEO / President and they'll assign you an advocate. It gets you to a single point of contact. Send your email to BofA CEO Brian Moynihan: brian.t.moynihan@bankofamerica.com

    Most posters here on loansafe will receive a response in 24 hours.

    BofA is extremely difficult to deal with even at the OOP level. I don't want to give you false hope, but some have had success doing this.

    I noticed it seems like a pain dealing with BoA. What is OOP level? Sorry I'm new to all of this. Oh and thank you very much for the email address

    Ok so someone did contact me the next day, but I missed the call. Well today I talked to him and come to find out my house already has a sell date! Which we had been assured over and over that our house hadn't been in the foreclosure process yet because they were in the modification process! He said he is going to try everything possible to keep us in our home. Keeping my fingers crossed because the sale date is set for July 3!!!

    Hi coler - I don't ever forget what it was like to be new here on these boards. Most people come here scared, confused, frustrated & just plain don't know which direction to turn. As you move forward, always remember "knowledge is power". The best thing you can do is keep reading here on the forum, educate yourself about foreclosure laws in your state, Texas Foreclosure Law. As I recall, things move rather quickly in Texas.

    There's 2 places you can search to confirm the trustee sale date https://www.recontrustco.com/upcomin...px?state=Texas & this site is constantly updated https://www.lpsasap.com/ . For the 2nd one I listed, you will need to set up an account & it's completely FREE. I suggest you check both sites to be certain.

    You can watch the calendar daily & as it gets 7-10 days prior to the sale date & it hasn't been cancelled, you can challenge the trustee. Be sure to do so in writing.

    I am all of the above . Thank you for all your tips, they really are helping. I can't help but think if I wouldn't have emailed OOP I wouldn't even know we were under foreclosure because they kept telling us we weren't. Yes it does move pretty quickly in Texas. I checked the sites and the first one doesn't show our address and the second site doesn't have Texas on the list. I thought we had to receive some sort of letter telling us the sale date? I just got a letter the other day stating that they received our paperwork and they would review our information for a loan modification? It is so confusing and BofA is constantly contradicting themselves?!?!

    Yes, you should receive a NOTS (notice of trustee sale) 21 calendar days prior to sale. So you'll need to look at a calendar & count backwards 21 days from July 3rd to see when that would be that you should receive notice. You can also try checking you county recorders office. Some provide online access so you can look to see if the notice has been recorded.

    Ok but I was told that if you are in being reviewed for a modification they can't foreclose??? I just received a letter this week saying they were reviewing our paperwork? We have been denied 3-4 times and each time because they didn't have all the paperwork they need?!?! Everytime they reopen our case. Oh and they paperwork they "need" I have already sent in but they finally told me it is the paperwork actually expires. The guy who is on our case said he will be in contact with me every 2-3 days. Again thank you for all the information. Without this site I wouldn't even know where to start.

    Hi coler - You are correct if being reviewed for a modification, the bank should not foreclose. Unfortunately, you can't trust what the reps tell you on the phone. So . . . . If & when the time comes, and there's no decision on a modification & sale date is looming, you can send a letter requesting a postponement. Across the top of your letter in big bold letters you will put:

    Cancel July 3rd Sale Date Loan Mod in active review status.

    Thank You. Who do I send it to? What do I put in the letter? Sorry we have never been in this kind of situation and it is a little intimidating!!

    I can work with you on the wording of the letter if needed. You will not need to send a letter until 7-10 days prior to sale. So we've got plenty of time to work on that.

    Your letter should also get faxed to the following departments within BofA:

    Hope department 1.800.658.0395 (fax number)
    Home Retention department 1.716.635.7255 (fax number)
    Advocacy Dept 1.866.261.6472 (fax number)
    MHA Escalations Unit 1.866.382.0489 (fax number)
    Homeownership Retention Department 714-792-5227 (fax number) new division in Brea California

    The idea here is to just reach 1 person that will re-code your file to "active review status". It's simply a numbers game. If your fax goes to 5 different departments, it may sit on 4 peoples desks & nothing gets done. So that's why it's very important to fax all of the above.

    Ok so I did receive the letter with a sale date! Even though I knew it was coming it still felt like I had been kicked in the stomach! The guy I'm working with from OOP is very helpful and is calling me every two days, which we have never had that happen. He said our numbers look good for a in home mod but he can't promise anything since its up to the underwriters. He said he can't request to postpone the sale date till 5 days prior??? I'm trying my hardest to be hopeful!!!!

    Your story sounds a lot like ours except we are not having luck with our advocate in the OOP. She had said from the initial phone call that she would be making contact with us, but that hasn't happened despite me leaving numerous messages. Like freedomwoman suggests keep educating yourself and checking the forum. Our sale date is August 10. I'm not sure if you are working with a HUD rep either but mine has been extremely helpful.

    Thank you so much for the encouragement! It makes me sad to think how many families lost their homes just because someone let their paperwork sit on someone's desk! It is a very scary and intimidating situation to be in and I can see why people just give up and walk away. I am so glad I found this forum because we almost did the same thing. I am not dealing with HUD yet because the rep from OOP has been very helpful. I'm gonna give him about a week and see what he can do for us! You and your family will be in my thoughts because I know how stressful all this can be. I hope you get the results you want and please keep me updated! Oh are you dealing with BofA also?

    Good Morning!

    Yes our loan is with B of A and the investor is Ginnie Mae. I will be contacting the Executive Office this morning. It is extremely stressful and I don't think the banks realize & care what they are putting families through. We still have more time than you so hopefully we will get some answers and our HUD rep has some ideas
    I will keep you & your family in my prayers as well. Make sure you document on paper every time you call or leave a message & ask for everything in writing don't agree over the phone. Also you can get the advice of an attorney, the first meeting is usually free.

    Hello Stressedmama,

    Well I called a HUD approved counselor today and she was kind of rude. Kind of surprised me, she said we probably won't get a mod and have to come up with at least half of our past due which would mean we would need 3500 in twenty days. Obviously if we had money set aside we wouldn't be in this situation! . Oh and she told me all this without even looking at numbers and she said her assistant would call me tomorrow to collect paperwork and SEE if she would CONSIDER taking my case! So I think I'm gonna have to put my faith in god and trust the person from BofA actually helps me this time. I did he find out he is a manager from OOP office so hopefully that means he knows what he is doing! Also I'm just gonna keep educating myself and emailing/calling whoever will listen to me

    Hi Coler:

    Wow I am sorry that you were treated like that, our HUD rep has been a big help. Did you get the name from the HUD website? I spoke to a customer advocate out of the OOP yesterday, soooo helpful. It was finally nice to speak to someone who understood our story & was willing to look into it, she also put in a request for a new CM since ours has not returned any phone calls and our file is just sitting there. We have nothing to lose if we start over, its just a fax. Try calling the customer advocate # 877.498.7226. Also if you haven't already contact the Making Homes Affordable 888.995.HOPE they might be able to be an advocate for you as well and will contact B of A three way and speak on your behalf. I did that yesterday as well, I could not believe I was on the phone for most of the day & was grateful to have the time off to make these calls since they are so time consuming.
