    Chapter 7 during loan modification process

    We are about to make our 4th trial payment. I've been told by BOA that they have all of our documents in order and our file is in review.

    We met with a bankruptcy attorney yesterday and he advised us to wait to see if our modification is approved before we file.

    If we are approved, can anyone tell me how long we need to wait after submitting the permanent docs before we can file? Our attorney hasn't worked with anyone doing a loan mod so he wasn't sure what the timeframe is.

    I am going through the same thing and we received our permanent mod and sent back signed copies on 3/1/10. Our attorney advised us to wait until our 1st permanent mod payment is posted and then they will start the filing. Our 1st payment is due 4/1/10. Good luck!

    Is there a reason that you can't file first before getting a modification? We kind of have to file soon, because my husband is starting to make too much money. Also, we were going to strip our 2nd thru the bk.

    I was given the phone# for the BofA BK Dept and asked general questions, the person who helped me stated that if I'm in MHA they help you finalize the process that as long as you have met your share of requirements you are good to go, he was a paralegal.
