You had conducted a conference call between Rachel Thomas of Citimortgage and *****in which certain terms were agreed to. Thank you for fulfilling your portion of what was agreed upon. The judge signed the cancelation of the foreclosure proceedings. Thank you once again. Unfortionarly Citimortgage has not fulfilled their portion. Attached is a detailed explanation of what has happened this past year. I have personally spoken with Senator John Thune of SD who lives in Sioux Falls, and he immediately offered his assistance if needed. I have emailed Senator Tim Johnson of SD and will ask for his assistance also since he is part of the US Senate Banking Committee. Can you forward this to the legal department at Citimortgage so they can first have the opportunity to settle this dispute before further action is taken by myself, my attorney and the US Senate Banking Committee. Once again, thank you for doing your part. |

Citi purchased the home at auction for the balance of the my loan. We were then in the 6 month redemption period that South Dakota has which only allows the homeowner to redeem the home by paying the entire balance due. Citi aggreed to BRING THE LOAN CURRENT IF WE PAID $15.095.67 as payment for all past due payments and all fees and charges, even after the sheriff's sale. We paid the exact amount. When the money was posted to the account they put some in esrow instead of appling it to the loan the way they origianlly caculated it. Not my problem. A definate oral contract was made. They did not make the loan current. I have asked repeadedly for them to just put thier miscaculation / past due to the back of the loan. Now it's lawsuit time. |
