Citi Mod not including taxes plus need to answer foreclosure

First of all, thank you for this board. I submitted my initial request for assistance on 12/23 and did not receive a response. I found this board and the Citi contact info and sent an email. I received immediate assistance and had to resend my info b/c the original request was either lost or ignored. We finally got the terms of the mod but also were served with foreclosure docs. It took them two weeks to send the mod which put us at the deadline for responding to the foreclosure (now). The mod shows taxes and/or insurance excrow to be less than the taxes and ins we owe. I read on the FAQs of the government's "Making Home Affordable" site that the taxes and insurance are to be included in the payment (which is supposed to be 31% of your gross mth income) even if this was not done in your prior loan. Our ins was previously escrowed but we paid our taxes of approx $2,100/year. Can Citi do this. It seems coincidental that we are served with foreclosure and get the mod right when we have to answer so that we feel pressured into signing it. We did not include our taxes in our monthly expenses b/c we thought the taxes would be included in our payment. That's $175/mth additional expenses which would impact our payment amount.
