As for tax liability, there is a state law that mirrors the federal mortgage forgiveness act, but as of right now, is is only applicable for debt forgiven in 2008. There is a bill in the assembly right now to extend that act, and most people feel it will pass - but as things stand right now there is a potential for state tax liability, unless you can prove insolvency.
