Yes they can. If it was my client... frankly from what you have described I wouldn't let him accept this offer for the simple fact that if your client proceeds to foreclosure lender wouldn't be able to pursue deficiency for that fact that the loans are non-recourse... You should definitely demand a full realease of liability or walk away from this deal.
