You don't have to have the chapter 7 discharged, but at least you can file for chapter 7 and take advantage of the automatic stay under chapter 7. Its worth asking your lawyer if you can do that. You might be able to buy yourself more time to see if you can qualify for the new programs that were announced today if your loan is with fannie or freddie.
Then another strategy you can try also that I have read about is to file a motion (in your case you would have to file it soon) to have Countrywide's attorney produce the original note as evidence they are even legally entitled to foreclose on you. I have read that in Ohio this has been successful in many courts, so what do you have to lose? |
