Keep in mind that if they sued you in New York state court, then "diversity jurisdiction" is inapplicable. Diversity jurisdiction allows an out-of-state plaintiff (the bank in this case) to sue for foreclosure in federal court, provided the amount in controversy exceeds $75,000. Standing, though, would still be an issue in any court--state or federal. |
