| HELP! Wachovia put my house in foreclosure! I need help.....I called Wachovia in June and was advised
to submit for a loan modification over the phone. They asked for the last two
pay stubs, which I faxed them. I was also advised while it was in modification
to not submit any payments as it would go to principle and not the payments.
They also advised me I could make xxx payment on July 6. Much to
my surprise I called their 1-800 number and was advised my loan was now
in foreclosure.
Fortunately, I had documented who I spoke with and their
agent Id no. Today, I called the foreclosure number and also
the executive escalation to advise them of what has happened.
I also put in for another modification, once again faxed my last 2 paycheck
stubs and also sent a hardship withdrawl letter. (the first time I did not send a
hardship letter) Fortunately, my finances
have greatly improved.
My questions are these:
1-I am worried sick they will take my home as in Texas, which is where I live,
they can foreclose in 30 days and have listed a sale date of August 3. Yes,
I will continue with the modification and call EVERY day and get agent id's.
However, should I contact an attorney? File Chapter 13 bankruptcy if the
modification does not go through? At this point I have no confidence with
Wachovia.
What alternative do I have if the modification does not go through?
How can I get them to accept they payment they agreed I could make on
July 6th?
Should I call Hud or Naca?
I have a lot of equity in the house, which is why I suspect they are
pushing this so quick for foreclosure.
